- 118.Terms of Reference for the Statement shall be provided by <strong>Council</strong> upon writtenrequest by an applicant. This requirement will be fully satisfied where anapplicant is required to submit an Environment Impact Statement pursuant to theAct.(c)(d)Where <strong>Council</strong> considers, having regard to any impact statement submitted andother relevant material, that a proposal for development conflicts significantlywith the intent of the Trinity Inlet Management Plan, <strong>Council</strong> may refuse theproposal.<strong>Council</strong> may impose conditions upon any approval for development which<strong>Council</strong> considers necessary to prevent or alleviate any potential conflict betweena development and the intent of the Trinity Inlet Management Plan.4.10.8 Drainage Problem Areas(a)Where pursuant to the provisions of <strong>Council</strong>'s Local laws an area within the<strong>Planning</strong> <strong>Scheme</strong> area has been declared a drainage problem area, all usespermitted without the Consent of the <strong>Council</strong> for particular zones shall cease tobe permitted development and become permissible development, provided thatall prohibited development shall remain prohibited development.4.10.9 Corner Truncations(a)(b)Wherever <strong>Council</strong>'s approval, Consent or permission is required pursuant to the<strong>Planning</strong> <strong>Scheme</strong>, it shall be lawful for <strong>Council</strong> to require a truncation not greaterthan 6 metres on each frontage by three equal chords where the proposed use islocated on an allotment which has two or more adjoining road frontages.The land comprising the truncation shall be dedicated as new road before the useis commenced and all costs associated with the truncation, including therelocation of any public utility mains, services and structures, shall be borne bythe applicant.4.10.10 Unzoned Land(a)(b)Development other than park and utility installation shall not be carried out onany unzoned land within the <strong>Planning</strong> <strong>Scheme</strong> area.Where a person wishes to undertake development on unzoned land, thenapplication shall be made to zone the land pursuant to Section 4.3 of the Act.
