- 130-In order to satisfy the need for public parkland generated by the increased populationas a result of development it is reasonable to require a contribution. Thiscontribution will take the place of land, works, money or a combination of these.To ensure that the development of a network of public parks occurs according to<strong>Council</strong>’s objectives and performance criteria, land required for public park shouldbe identified during planning for the development and provided at the time of finalapprovals relating to the development (in most cases plan sealing).Acquiring land through developer contribution (either as a direct land contribution oras a contribution to the purchase price of appropriate land), is seen as the mostefficient way to provide the land base for a network of public parks.The alternative of purchasing land (where available) after developments arecompleted and homes built, is not feasible as acquisition costs would be multiplied,residents would have had no opporhmity to choose blocks on the basis of parklocation and servicing the park would be more difficult once development wascomplete. This approach would also limit the use of integrated urban design inproviding equitable access to quality park land.5.12.5 Determination of contributionIn determining an application for reconfiguration of a lot by way of subdivision<strong>Council</strong> may require that in accordance with section 5.6 of the LGP&E Act 1990:(a)(b)(c)(d)an area of land be transferred to <strong>Council</strong> for use as park landa monetary contribution be paid in lieu of that landworks be provided for the improvement of land to be used as a parkany combination of (a), (b), and (c).In determining whether to accept land, works, money or a combination of these,<strong>Council</strong> will consider:compliance with any LAOSMP affecting the subject landcompliance with the Park <strong>Planning</strong> Performance Criteria 2 ( as detailed in theDevelopment Manual) and the Land Contribution for public park- performancecriteria (section 1.8)the quqtum of land offeredexisting provision of parkland in the areathe possibility of connecting the proposed park with the existing or proposedopen space systemthe type and style of development and likely demand generatedthe size of the block to be developed.The location of preferred areas of major open space indicated in the StrategicPlan and in Develoment Control Plan 4.Section 5.6 of the LGP&E Act 1990Any planning scheme policy prepared regarding this matter.The Park <strong>Planning</strong> Performance Criteria are contained in Part 4 of the Development Manual forthe City of <strong>Cairns</strong>
