- 146 -Application deemed not to be madeAn application made pursuant to this Sub-section shall be deemed not to have been madeunless the provisions of this Section and the Act have been complied with in full:Subdivisions involving worksWhere the Council has approved an application for subdivision subject to conditions whichinclude the construction of works to be undertaken by the applicant, the applicant shallsubmit engineering drawings and specifications for the required works together with anapplication for approval of such drawings and specifications within the time periodspecified by the Act. The engineering specifications shall contain references to anyrelevant conditions or subdivision approval to the satisfaction of the City Engineer.An application 6.2 shall:-(4(b)be on a form as determined by the Council; andbe accompanied by the engineering drawings and specifications for the requiredworks together with any relevant information including, but not limited to:-(i)(ii)the location of all service conduits; anddetails of the construction schedule; and(iii) details of dust control measures and method of disposal of waste materialsincluding vegetation; and(iv) the extent and finished levels of any proposed filling or excavationoperations, the location of batter banks, the source and nature of all fillmaterials and details of the route external of the site to be used by haulagevehicles; and(c)(d)(e)(0be accompanied by a report from a soil testing organisation acceptable to the CityEngineer showing compaction requirements and settlement characteristics for anyfill material to be used in the subdivision; andbe accompanied by such Certificates as required by the Council under theprovisions of this Planning Scheme; andwhere applicable, be accompanied by written approval from the adjoiningproperty owners consenting to accept any necessary stormwater discharge andauthorising any engineering works on their property; andbe accompanied by an application fee of an amount in accordance with a Scheduleof Fees determined by the Council by resolution.After submission of an application, the City Engineer may, in writing, request thesubmission of calculations or of additional or amended engineering drawings orspecifications.In accordance with the Act, the Council herein delegates its powers to make decisions tothe City Engineer who may approve of the engineering drawings and specifications with orwithout conditions. Provided that:-(a)where a subdivision has frontage to a State-confroIIed road under the provisions ofthe Transport Infrastructure (Roads) Act, such approval shall not be granted untilany necessary approval has been obtained from the Department of Transport/MainRoads and such approval shall include any conditions imposed by the Departmentof TransportMain Roads which are considered reasonable and relevant; and
