and must identify the particular records to be disclosed, the purpose of the disclosure,<br />
and the people to whom such disclosure is to be made. A copy of the<br />
consent must be maintained with the student’s record. Unless the consent form<br />
specifies that the information may be disclosed further, an attached statement<br />
shall also include a warning against further disclosure by the recipient.<br />
When the FBI or civil service investigators come to <strong>Pellissippi</strong> <strong>State</strong> to investigate<br />
the backgrounds of students, these people report to Admissions and<br />
Records to check such details as terms attended, courses taken, degree, gradepoint<br />
average, date of birth, place of birth, and home address. Personnel in<br />
Admissions and Records may identify the name and location of faculty members<br />
who taught the student in question.<br />
Before any information is released from Admissions and Records, the investigator<br />
must produce a signed release form from the student, a copy of which is<br />
filed in the student’s record. Under the Family Educational Rights and Privacy<br />
Act, a <strong>Pellissippi</strong> <strong>State</strong> employee must view the release form before releasing any<br />
information on a student.<br />
D i s c l o s u re Pursuant to Subpoena. <strong>Pellissippi</strong> <strong>State</strong> must disclose confidential<br />
student records pursuant to a lawfully issued subpoena or judicial order. Upon receipt<br />
of a subpoena or judicial order, the appropriate custodian of records shall examine<br />
the subpoena or order to verify that it has been executed by an officer of the court or<br />
other authorized official. (The Office of General Counsel of TBR may be contacted<br />
for assistance in verification.) Prior to disclosure, <strong>Pellissippi</strong> <strong>State</strong> must use responsible<br />
efforts to notify the student of the receipt of the subpoena or order and of the<br />
i n s t i t u t i o n ’s intent to comply. If the <strong>College</strong> is unable to contact the student prior to<br />
the disclosure, it must do so as soon thereafter as is feasible. Oral notification should<br />
be followed by a written confirmation, a copy of which shall be maintained along<br />
with a copy of the subpoena and record of the disclosure with the student’s record.<br />
D i s c l o s u re to Parents of Dependent Students. <strong>Pellissippi</strong> <strong>State</strong> may disclose<br />
personally identifiable student records to parents of a student only if the student is a<br />
dependent of the parent as defined in Section 152 of the Internal Revenue Code.<br />
Disclosure to Officials of Other Schools and School Systems. <strong>Pellissippi</strong><br />
<strong>State</strong> may disclose confidential student records to officials of other schools or<br />
school systems in which the student is currently enrolled or seeks or intends to<br />
enroll, provided the following conditions are met:<br />
• <strong>Pellissippi</strong> <strong>State</strong> makes a reasonable attempt to notify the student of the disclosure<br />
at the student’s last known address.<br />
• <strong>Pellissippi</strong> <strong>State</strong> provides the student a copy of the records.<br />
• <strong>Pellissippi</strong> <strong>State</strong> provides the student an opportunity for a hearing upon<br />
request.<br />
The <strong>College</strong> does not have to attempt notice to students if the disclosure is initiated<br />
by the student and if <strong>Pellissippi</strong> <strong>State</strong> includes a notice in its policies and<br />
procedures that it forwards education records on request to a school in which a<br />
student seeks or intends to enroll.<br />
D i s c l o s u re of Deceased Student Records. <strong>Pellissippi</strong> <strong>State</strong> does not permit the<br />
release of educational records of a deceased student without the written permission<br />
of the executor/executrix (or parents/next of kin, if an executor/executrix has not<br />
been appointed) of the deceased student.
