(5) no officer or member of the association will use<br />

his or her official Coast Guard position to<br />

further the interests of the association; and<br />

(6) the Association secures general liability<br />

insurance as appropriate. Private associations<br />

are not considered to be instrumentalities of the<br />

government for purposes of the Federal Tort Act<br />

and, consequently, the government is not liable<br />

for the association's activities. Insurance<br />

coverage for the conduct of routine business<br />

meetings, however, while encouraged, is generally<br />

not critical as the risk and extent of liability<br />

is small, <strong>On</strong> the other hand, if the association<br />

sponscrs an event or activity, it must determine<br />

on, a case by case basis, the need for general<br />

liability coverage. Of particular concern would<br />

be any circumstances or events which involve:<br />

(a) Guests or the public.<br />

(b) Increased risk of injury (i.e., athletic<br />

events, fireworks, etc.)<br />

(c) .Consumption of alcoholic beverages.<br />

In general, private associations should be very<br />

care'ful in determining the type of events<br />

sponsored, where they are held, eligible<br />

parti+pai&s, and how much liability is assumed<br />

in organizing an event.<br />

The association's pursuits and operations are not<br />

adverse to any of the policies and directives<br />

promulgated by the <strong>DOT</strong> or the Coast Guard.<br />

The activities of the ,association and the actions,<br />

behavior and conduct of its members and guests do not<br />

embarrass the <strong>DOT</strong> or the Coast Guard.<br />

The association does not engage in any activity which<br />

competes with Coast Guard non-appropriated fund<br />

activities.<br />

The constitution or equivalent document specifically<br />

provides for the proper disposition of residual<br />

assets and liabilities upon dissolution.<br />

The association is self-sustaining.<br />

The association does not discriminate because of age,<br />

sex, .race, color, religion, national origin, or<br />

physical handicap.<br />
