lawful demand of sub-contractor's workmen supplier or employees, the contractor,
shall in such cases indemnify and keep the owner and/or their representative
harmless from all lesson, damages, expenses decrease arising out of such action.
19.0. OWNER NOT BOUND BY PERSONAL REPRESENTATION.
19.1 The contractor shall not be entitled to any increase on the scheduled rates or any
other right or claim whatsoever by reason of any representations, explanation
statement or alleged representation, promise or guarantees given or called to have
been given to him by any person. The owner has the right to split out the work in
parts and may award to different agencies.
20.0 PAYMENT TERMS
20.1 The payment will be done on monthly basis on receipt of duly certified bill for
previous months’ services rendered along with
i. Copy of PF challan submitted to PF authority.
ii. Copy of ESI challan submitted to authority.
iii. Copy of Group insurance policy ( Rs. 2 Lacks against each employee).
iv. Pay slip in the name of individual employee.
20.2 These rates shall be valid during the currency of the maintenance contract
and includes all types of taxes, transportation, conveyance, contractor’s
profit, watch & ward.
20.3 The payment shall be made after necessary deduction of Income Tax, WCT
etc. and any other applicable statutory deductions from time to time.
20.4 INVOICING Bills/ Invoices will be made in the name of GAIL (INDIA) Ltd.,
NOIDA in duplicate and shall be sent to EIC. The invoice should be
preferred in accordance with Rule 4A of service tax rules, as GAIL is
indented to avail contract credit under service tax rules.
20.5 All payments shall be released within 15 days after receipt of relevant
documents complete in all respects and certified by EIC. No interest charges
for delay in payment, if any, shall be borne by Owner. The Contractor’s
request(s) for payment shall be made to Owner in writing accompanied
by an invoice describing, as appropriate, the Goods delivered and services
performed and by shipping documents submitted and upon fulfillment of
other obligations stipulated in the Contract.
20.6 COMPUTERISED BILLING SYSTEM : GAIL (India) Limited has introduced
Computerized Billing System whereby when the Bills are submitted in GAIL by
a Contractor, a receipt number is generated. The Contractor can know
the status of the Bill through GAIL’s website.
