21.0 COMPENSATION FOR EXTENDED STAY 21.1 No compensation for extended stay is payable to contractor for this work 22.0 Sub Contractor/Sublet 22.1 Contractor shall in no case lease/transfer/sublet/appoint caretaker for services 23.0 CONTRACT PERIOD 23.1 The contract shall be valid for a period of TWO years from the date of award of work i.e. 24 months from the date of LOA and may be extended further for SIX months on same terms and condition on the sole discretion of GAIL. GAIL reserves the right to terminate the contract without assigning any reason during the currency of the contract period by giving 30 days notice to the contractor. 24.0 INSTRUCTION FOR CONTRACTOR/ RESPONSIBILITY OF THE CONTRACTOR 24.1 It is expected that the Contractor in order to provide efficient and effective services, would deploy competent personnel. No other person except Contractor’s authorized representative shall be allowed to enter GAIL Office and associated premises without the permission of EIC or its authorized representative. Contractor shall also not entertain any outsider or extend any service beyond GAIL’s premises If for security or any other reason any of the personnel deployed by the Contractor for the services contracted out herein is reported or found undesirable such personnel shall not be permitted entry into the GAIL premises and the Contractor is expected to take the necessary appropriate action 24.2 Within the GAIL’s premises, the Contractor’s personnel shall not do any private work other than their normal duties. 24.3 Contractor shall be directly responsible for any/all disputes arising between him and his personal and keep GAIL-Delhi indemnified against all loses, damages and claims arising thereof. 24.4 Contractor shall be solely responsible for payment of wages/remuneration including allowance to his/its personnel that might become applicable under any new act or order of Government. GAIL shall have no liability whatsoever in this regard. 24.5 Contractor shall be fully responsible for theft, burglary, fire or any mischievous deeds by his/its staff. 24.6 List of persons employed by Contractor for the subject work mentioning qualifications, experience and residential address shall be submitted to GAIL. In case of any change, the same shall be informed to GAIL from time to time. 24.7 GAIL reserves the right to obtain Contractor’s services on holidays as well as beyond the specified working hours, by giving prior notice of one day. 24.8 The contractor shall be responsible for injury to any body, breakage, loss or damage to the equipment, machinery, appliance or properties connected therewith, caused by the negligence & act of omission or commission by the contractor, their staff,. 24.9 The contractor shall indemnify GAIL for any accidental reason etc. caused by his labour, defective workmanship etc. 24.10 The contractor shall abide by the rules & regulations of the security. The contractor’s staff shall have regular uniforms & shoes to be provided by the contractor. The contractor shall provide one pair personal safety kit consisting of two nos. of cotton shirt , two nos. of pant and one pair of industrial safety shoes to its employees every year , photo-passes to the personnel deployed by him, if any, in connection with the services contracted out herein, without which the personnel, if any deployed will not be permitted to enter GAIL premises for security reasons. The contractor is expected to maintain antecedents of all the personnel deployed for the services contracted out herein, for security and safety reasons and furnish the same when called for. 24.11 Any material taken into the building or taken out from the building, shall have necessary permission from the security personnel/higher authority of the GAIL. 24.12 All services are to be offered as per ISI code of practices, wherever required/applicable. 24.13 Major repairing work required at service center, major overhauling and top Overhauling is not covered in this scope of the work. 24.14 Any damage caused by the contractor or his personnel to the building and its equipments should be repaired/replaced by the contractor at his own cost. If the repair /replacement job is not done by the contractor within a reasonable time then, GAIL will get it done and the cost so incurred will be deducted from the contractor’s bill. 24.15 GAIL will provide a suitable space for the storing of the tools and tackles, spares, Consumables of the contractor, however, contractor has to make arrangements for his almirah/locker etc. for the safety of its equipments GAIL will not be responsible for any misplacement or damage or theft of the contractor’s equipments or any other articles. 24.16 Water & Electricity will be provided free of cost to the contractor for the maintenance of the system. 24.17 The contractor shall have the responsibility to co-ordinate control and supervise the staff and external party called to carry out maintenance job. 24.18 Contractor will have to make all necessary arrangements for security & safety of his persons and work place like providing safety belts, shoes, helmets, proper illumination of work place etc. Tender/Bid Document No: GAIL/NCR/C&P/6114 ARC for O&M Services 107
