administration/inspection charge thereof, wherever applicable, in respect of the personnel deployed by him relating to the work of GAIL. 30.8 The contractor shall ensure and will be solely responsible for payment of wages and other dues latest by 7th of the following month to the personnel deployed by him in the presence of Engineer-in-charge or his representative. The contractor shall be directly responsible and indemnify the company against all charges, claims, dues, etc. arising out of disputes relating to the dues and employment of personnel deployed by him. 31.0 PENALTY CLAUSE: 31.1 Non-attendance of technical maintenance work as specified in the tender document scope of work clause 4.0 will attract a penalty of 01% of total monthly amount of the Contractor . 32.2 In case of unreasonable delay in attending the maintenance points the Engineerin-charge can get the work done/maintenance points attended by other party at the risk and cost of the contractor. The expenditure along with extra 15% shall be deducted from the bill of the contractor and paid to the concerned party directly if the contractor fails to make the payment within time given by Engineerin-charge. 32.3 Non-provision of providing operation services in a shift will attract a penalty of Rs.200/- per shift per day in addition to non-entitlement of payment for the shift. 32.4 Non-provision of providing Assistance services in General duty as specified in the tender document scope of work clause 2.0 will attract a penalty of Rs.200/- per day in addition to non-entitlement of payment for that day. 32.5 The decision of the Engineer-in-charge/site –in-charge will be final and binding to the Contractor in this regard. 33.0 PRICE BASIS: 33.1 The quoted rate shall be firm and valid till the complete execution of the order. No escalation on what-so-ever account shall be paid under this contract. 33.2 All charges such as wages, insurance, EPF, ESI and other statutory payments admissible to the contract laborers, as applicable, should be considered while quoting the rates.. 33.3 The rates should be quoted in the schedule of rates as enclosed. 33.4 Bidders are advised in their own interest to visit office and ascertain the conditions and quantum of work before quoting. 33.6 The rates quoted by the Bidder shall be all inclusive for provisions of all incidental expenses necessary for proper execution and completion of work in full in accordance with the Terms & Conditions of the Bid Documents 34.0 TIME FOR START AND MOBILISATION: 34.1 After award of work, GAIL shall give 7 days period for initial mobilization. Contractor/Agency shall ensure mobilization within the given time for smooth execution of job as specified by GAIL. In case the bidder is not able to mobilize within the time specified above, a penalty @ Rs.500/- per day . 35.0 LICENSE 35.1 Labour License : Contractor shall obtain an appropriate license from concerned authority under the contract labour (Abolition and regulation) Act 1970 within one months from the date of LOI and furnish copy of the same to Owner. Contractor shall also be responsible for its validity and for complying with provisions of all applicable Acts, rules & regulation in force at the site of work. 36.0 STATUTORY APPROVALS 36.1 The approval from any authority required as per statutory rules and regulations of central/ state government shall be the contractor’s responsibility unless other wise specified in the tender document. 37.0 BONUS FOR EARLY COMPLETION 37.1 In partial modification to Clause No. 27.3 of General Conditions of Contract, bonus for early completion is not applicable for this work. 38.0 PAYING AUTHORITIES Manager (Finance) GAIL, NOIDA, shall be the paying authority for this Contract 39.0 EVALUATION OF BIDS 39.1 Bids shall be evaluated on the basis of over all amount quoted for each section as per scope of works to complete the job in all respect. RATES WILL BE INCLUSIVE OF ALL TAXES. 40.0 CONFIDENTIALITY 40.1 Confidential information shall mean and include all data, documents, papers, data base, correspondence and any other information relating to GAIL, its business, operation etc. Contractor shall maintain the confidentiality and shall neither disclose to anyone nor use the same for any purpose, what so ever with out prior written approval of GAIL.
