CONTRACTOR shall, within 7 days of the date of receipt of order to carry out<br />

the WORK, in<strong>for</strong>m the ENGINEER-IN-CHARGE of the rates which it is his<br />

intention to charge <strong>for</strong> such class of WORK, supported by analysis of the rate<br />

or rates claimed, and the ENGINEER-IN-CHARGE shall determine the rate or<br />

rates on the basis of the prevailing market rates, labour cost at schedule of<br />

labour rates plus 10% to cover contractor's supervision, overheads and profit<br />

and pay the CONTRACTOR accordingly. The opinion of the ENGINEER- IN-<br />

CHARGE as to current market rates of materials and the quantum of labour<br />

involved per unit of measurement will be final and binding on the<br />

CONTRACTOR.<br />

d) Where the item of work will be executed through nominated specialist<br />

agency as approved by the ENGINEER-IN-CHARGE, then the actual amount<br />

paid to such nominated agency supported by documentary evidence and as<br />

certified by ENGINEER-IN-CHARGE shall be considered plus 10% (ten<br />

percent) to cover all contingencies, overhead, profits to arrive at the rates.<br />

e) Provisions contained in the Sub-clause (a) & (d) above shall, however, not<br />

apply <strong>for</strong> the following:- Where the value of additions of new items together<br />

with the value of alterations, additions/deletions or substitutions does not<br />

exceed by or is not less than plus/minus (+_)25% of the VALUE OF<br />

CONTRACT. The item rates in the Schedule of <strong>Rate</strong>s shall hold good <strong>for</strong> all<br />

such variations between the above mentioned limits, irrespective of any<br />

increase/decrease of quantities in the individual items of Schedule of <strong>Rate</strong>s.<br />

Where the value of addition of new items together with the value of<br />

alterations, additions/deletions or substitutions reduces more than 25% of<br />

the contract value but is within the following limits the tenderer shall be paid<br />

compensation <strong>for</strong> decrease in the value of work, as follows: S.No. Range of<br />

Variation Percentage compensation <strong>for</strong> decrease in the value of work in the<br />

respective range. a) Beyond (+) 25% No increase and/or upto & inclusive of<br />

decrease shall be (+) 50% applicable <strong>for</strong> the Schedule of <strong>Rate</strong>s (The rates<br />

quoted <strong>for</strong> this increase shall be valid). b) Beyond (-) 25% upto & For<br />

reduction beyond inclusive of (-) 50% 25%contractor shall be compensated<br />

by an amount equivalent to 10% of the reduction in value of the contract as<br />

awarded. For example if the actual contract value is 70% of awarded value<br />

then compensation shall be 10% of (75-70) i.e. 0.5% of awarded contract<br />

value. II. For Lumpsum <strong>Contract</strong>s CONTRACTOR shall, within 7 days of the<br />

date of receipt of order to carry out the WORK, in<strong>for</strong>m the ENGINEER-IN-<br />

CHARGE of the rates which it is his intention to charge <strong>for</strong> such class of<br />

WORK, supported by analysis of the rate or rates claimed, and the<br />

ENGINEER-IN-CHARGE shall determine the rate or rates on the basis of the<br />

prevailing market rates, labour cost at schedule of labour rates plus 10% to<br />

cover contractor's supervision, overheads and profit and pay the<br />

CONTRACTOR accordingly. The opinion of the ENGINEER- IN-CHARGE as to<br />

current market rates of materials and the quantum of labour involved per<br />

unit of measurement will be final and binding on the CONTRACTOR.<br />

61 Drawings to be supplied by the employer<br />

61.1 The drawings attached with tender are only <strong>for</strong> the general guidance to the CONTRACTOR to<br />

enable him to visualize the type of work contemplated and scope of work involved. The<br />

CONTRACTOR will be deemed to have studied the DRAWINGS and <strong>for</strong>med an idea about the<br />

WORK involved.<br />
