measurements and in case there are any missing items or measurements the same shall be<br />

recorded.<br />

88.1.7 COMPUTERISED BILLING SYSTEM : <strong>GAIL</strong> (India) Limited has introduced Computerised Billing<br />

System whereby when the Bills are submitted in <strong>GAIL</strong> by a <strong>Contract</strong>or, a receipt number is<br />

generated. The <strong>Contract</strong>or can know the status of the Bill through <strong>GAIL</strong>’s website.<br />

88.2 SECURED ADVANCE ON MATERIAL: Unless otherwise provided elsewhere in the tender, no<br />

`Secured Advance' on security of materials brought to site <strong>for</strong> execution of contracted<br />

items(s) shall be paid to the <strong>Contract</strong>or whatsoever.<br />

88.3 DISPUTE IN MODE OF MEASUREMENT: In case of any dispute as to the mode of<br />

measurement not covered by the CONTRACT to be adopted <strong>for</strong> any item of WORK, mode of<br />

measurement as per latest Indian Standard Specifications shall be followed.<br />

88.4 ROUNDING-OFF OF AMOUNTS: In calculating the amount of each item due to the<br />

CONTRACTOR in every certificate prepared <strong>for</strong> payment, sum of less than 50 paise shall be<br />

omitted and the total amount on each certificate shall be rounded off to the nearest rupees,<br />

i.e., sum of less than 50 paise shall be omitted and sums of 50 paise and more upto one<br />

rupee shall be reckoned as one rupee.<br />

89 Lumpsum in tender:<br />

89.1 The payment against any Lumpsum item shall be made only on completion of that item as<br />

per the provision of the CONTRACT after certification by ENGINEER-IN-CHARGE.<br />

90 Running account payments to be regarded as advance:<br />

90.1 All running account payments shall be regarded as payment by way of advance against the<br />

final payment only and not as payments <strong>for</strong> WORK actually done and completed and shall not<br />

preclude the requiring of bad, unsound and imperfect or unskilled work to be removed and<br />

taken away and reconstructed or re-erected or be considered as an admission of the due<br />

per<strong>for</strong>mance of the CONTRACT, or any part thereof, in this respect, or of the accurring of any<br />

claim by the CONTRACTOR, nor shall it conclude, determine or affect in any way the powers<br />

of the EMPLOYER under these conditions or any of them as to the final settlement and<br />

adjustment of the accounts or otherwise, or in any other way vary or affect the CONTRACT.<br />

The final bill shall be submitted by the CONTRACTOR within one month of the date of<br />

physical completion of the WORK, otherwise, the ENGINEER-IN-CHARGE's certificate of the<br />

measurement and of total amount payable <strong>for</strong> the WORK accordingly shall be final and<br />

binding on all parties<br />

91 Notice of claims <strong>for</strong> additional payments:<br />

91.1 Should the CONTRACTOR consider that he is entitled to any extra payment <strong>for</strong> any<br />

extra/additional WORKS or MATERIAL change in original SPECIFICATIONS carried out by him<br />

in respect of WORK he shall <strong>for</strong>thwith give notice in writing to the ENGINEER-IN-CHARGE<br />

that he claims extra payment. Such notice shall be given to the ENGINEER-IN-CHARGE upon<br />

which CONTRACTOR bases such claims and such notice shall contain full particulars of the<br />

nature of such claim with full details of amount claimed. Irrespective of any provision in the<br />

CONTRACT to the contrary, the CONTRACTOR must intimate his intention to lodge claim on<br />

the EMPLOYER within 10 (ten) days of the commencement of happening of the event and<br />

quantify the claim within 30 (thirty) days, failing which the CONTRACTOR will lose his right to<br />

claim any compensation/reimbursement/damages etc. or refer the matter to arbitration.<br />

Failure on the part of CONTRACTOR to put <strong>for</strong>ward any claim without the necessary<br />

particulars as above within the time above specified shall be an absolute waiver thereof. No<br />
