24.19 <strong>Contract</strong>or’s staff should have courteous behavior any lapse on this part shall entail<br />

immediately removal of the person from site by the <strong>Contract</strong>or.<br />

24.20 Non-availability of competent staff, unsatisfactory maintenance of system shall be<br />

treated as breach of <strong>Contract</strong>.<br />

24.21 <strong>GAIL</strong> shall have no responsibility on any account <strong>for</strong> the personnel that may be<br />

deployed by the <strong>Contract</strong>or. The <strong>Contract</strong>or shall remain solely responsible <strong>for</strong> his<br />

manpower and bound by all labour and other legal laws and compliance thereof,<br />

in respect of his personnel.<br />

24.22 If <strong>for</strong> security or <strong>for</strong> any other reason any of the personnel deployed by the<br />

<strong>Contract</strong>or <strong>for</strong> the services contracted out herein is reported or found<br />

undesirable, such personnel shall not be permitted entry into the <strong>GAIL</strong> premises<br />

and the <strong>Contract</strong>or is expected to take necessary appropriate action.<br />

24.23 The contractor shall indemnify the Company against all losses or damages caused to<br />

it on account of acts of the personnel deployed by the contractor.<br />

24.24 All the installation of <strong>GAIL</strong> <strong>NCR</strong> offices s mentioned in Work Centers should be<br />

maintained.<br />

24.25 <strong>Contract</strong>or has to issue PF card, ESI card, Group Personal Accident Insurance<br />

cover to the deployed personnel’s wherever applicable in this contract.<br />

24.26 <strong>Contract</strong>or has to maintain different registers showing the details of the name<br />

of the employee, no. of days work in a month, leave details, overtime details,<br />

and wages paid per month etc as per the requirement contract labour<br />

(Regulation & Abolition) Act 1970.<br />

24.27 <strong>Contract</strong>or has to provide weekly off to the deployed personnel.<br />

24.28 <strong>Contract</strong>or has to provide shift reliever/ leave reliever as per the provision of<br />

Labour act.<br />

24.29 <strong>Contract</strong>or has to get the wage register certified and signed by the EIC or its<br />

authorized representative while disbursing the wages to the deployed<br />

personnel’s.<br />

24.30 The contractor has to pay wages and bonus and provide certain benefits<br />

and amenities to his workers as per contract labour (R&A) Act 1970 and<br />

in case contractor fails to do so, the principal employer (<strong>GAIL</strong>)<br />

will provide these and at a cost to contractor.<br />
