9.222 The Company’s construction <strong>of</strong> a railway between Athlone and Galway was<br />

financed by a £0.5m loan by HM Treasury that was authorised by the Advance <strong>of</strong><br />

Money (Athlone to Galway Railway) Act 1849. 464 This loan, which has long since<br />

been repaid, enabled the Company to complete the construction and open the<br />

railway to the public on 1 August 1851. 465 The discharge <strong>of</strong> the loan means that<br />

the 1849 Act is now unnecessary and may be repealed.<br />

9.223 The Company sponsored many other enactments in connection with the<br />

construction, finance and operating <strong>of</strong> its railways. These enactments were<br />

passed at a time when the whole <strong>of</strong> Ireland formed part <strong>of</strong> the United Kingdom.<br />

The establishment <strong>of</strong> the Irish Free State in 1922 has meant that these<br />

enactments, whilst remaining on the statute book <strong>of</strong> the United Kingdom, no<br />

longer have any effect within the United Kingdom. Accordingly these enactments<br />

may now be repealed as unnecessary so far as the United Kingdom is<br />

concerned. Their status within the Republic <strong>of</strong> Ireland, where they remain in<br />

force, will not be affected by their repeal for the United Kingdom.<br />
