PUBLIC HEARINGS<br />

Case PZ10-32: Public hearing and recommendation to <strong>City</strong> Council regarding the proposed<br />

Special Use Permit for 7.602 acres out the A.M. Esnaurizar Survey, located on SH 46 South,<br />

adjacent to Stone Gate Subdivision, to allow a maximum density <strong>of</strong> 16 units per acre in an "R-3L"<br />

Multifamily Low Density District. (Brass Real Estate Growth Fund IV, LP)<br />

Mr. Greene briefed the Commission on the history <strong>of</strong> the development. He noted that 20 notices were<br />

sent to property owners within 200 ft. <strong>of</strong> the subject property; two responses were received in favor <strong>of</strong> the<br />

Special Use Permit (#2 and 4) and five in opposition (#8, 10, 14, 16 and 20). He concluded by stating that<br />

staff recommended approval <strong>of</strong> the proposed Special Use Permit, which was compatible with the mix <strong>of</strong><br />

existing commercial and residential development adjacent to SH 46 South <strong>of</strong> IH 35, and would act as a<br />

buffer between the single-family residentially zoned properties to the north and northeast and the<br />

commercially zoned property adjacent to SH 46.<br />

Chair Casteel asked if there was anyone to speak in favor <strong>of</strong> the Special Use Permit.<br />

Mario Gonzales, 103 Teich Loop, spoke for the developer. He reported that a drainage study had been<br />

conducted and the developer had worked with neighbors to address drainage and buffering issues.<br />

Chair Casteel asked if anyone wished to speak in opposition. No one spoke.<br />

A motion to close the public hearing was made by Vice Chair Elrod, seconded by Commissioner Namken,<br />

and passed unanimously. (9-0-0)<br />

Motion by Commissioner Bearden, seconded by Commissioner Hoyt, that Case PZ1 0-32 be forwar.ded to<br />

<strong>City</strong> Council with a recommendation to approve. The motion carried unanimously. (9-0-0)<br />
