PUBLIC HEARINGS<br />

Case PZ10-42: Public hearing and recommendation to <strong>City</strong> Council regarding the proposed<br />

rezoning <strong>of</strong> portions <strong>of</strong> the 500 and 700 blocks <strong>of</strong> Hill Avenue, from "M-1" Light Industrial District<br />

to "SND-1" Special Neighborhood District. (<strong>City</strong> <strong>of</strong> <strong>New</strong> <strong>Braunfels</strong>)<br />

Ms. Bell said the rezoning <strong>of</strong> the Hill Avenue neighborhood was not as clear cut as that <strong>of</strong> Oak Run<br />

Subdivision since it had developed over time to include residential and commercial uses. She said the<br />

500 and 700 blocks consisted <strong>of</strong> houses which had been in residential use for over 60 years and when<br />

the south side <strong>of</strong> Hill Avenue was rezoned to SND-1 in 2007, some <strong>of</strong> the property owners within this area<br />

contacted the <strong>City</strong> requesting their neighborhood be part <strong>of</strong> the current rezoning effort. She noted that a<br />

public neighborhood meeting for the affected property owners was held on October 20, 2010, with two<br />

residents attending and voicing their support <strong>of</strong> the zone change. She further added that public hearing<br />

notices were sent to the 11 property owners <strong>of</strong> the 500 and 700 Block <strong>of</strong> Hill Avenue and 63 property<br />

owners located within 200 feet; five responses were received in favor, one against, and one was returned<br />

undeliverable. Ms. Bell said staff recommended approval <strong>of</strong> the rezoning as it was consistent with the<br />

current use and intent <strong>of</strong> the existing residential buildings and the goals and priorities <strong>of</strong> the<br />

Comprehensive Plan.<br />

Vice Chair Elrod asked if there was anyone in the audience who wished to speak in favor <strong>of</strong> the rezoning.<br />

John and Christa Lovett, 760 S. Hill St., said they were highly in favor <strong>of</strong> the rezoning.<br />

Vice Chair Elrod asked if there was anyone in the audience who wished to speak in opposition to the<br />

rezoning.<br />

Liz Adams, 228 Preston Hollow, and Gary Nolte, 2071 Club Crossing, said they co-"owned the property at<br />

751 S. Hill St. , which consisted <strong>of</strong> a single family home and duplex. Ms. Adams said they intended to use<br />

the property for overnight rentals, a use that the SND-1 zoning would not allow. She felt that the new<br />

zoning classification was a violation <strong>of</strong> their rights and asked that the property be grandfathered.<br />

A motion to close the public hearing was made by Commissioner Massouh, seconded by Commissioner<br />

Hoyt, and passed unanimously. (8-0-0)<br />

Commissioner Myrick moved that Case PZ10-42 be forwarded to <strong>City</strong> Council with a recommendation to<br />

approve. The motion was seconded by Commissioner Massouh, and carried with Vice Chair Elrod, and<br />

Commissioners Bearden and Perez voting "no". (5-3-0)<br />
