38 RESOLUTION NO. 2010 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEW BRAUNFELS, TEXAS, APPROVING A BOUNDARY AGREEMENT AMONG THE CITY OF NEW BRAUNFELS, CITY OF SCHERTZ, DENNIS R. ENGEL AND JEANNINE C. ENGEL, AND DAVID W. ENGEL AND MONIKA M. ENGEL; AND DECLARING AN EFFECTIVE DATE. I WHEREAS, properties owned by Dennis R. Engel and Jeannine C. Engel (the "Dennis Engel Property"), and David W. Engel and Monika M. Engel (the "David Engle Property") are currently within the extraterritorial jurisdiction ("ET J") of the City of Schertz, Texas ("Schertz"); and WHEREAS, Dennis and Jeannine Engle and David and Monika Engel have requested that the Dennis Engel Property and the David Engel Property be released from the ET J of Schertz to the ET J of the City of New Braunfels and be annexed by the City of New Braunfels; and WHEREAS, Schertz has agreed to release the Dennis Engel Property and the David Engel Property from the ET J of Schertz to the ET J of the City of New Braunfels and the City of New Braunfels has agreed to annex the Dennis Engel Property and the David Engel Property into its corporate boundaries no later than December 31, 2011; and WHEREAS, the parties have negotiated a Boundary Agreement that sets out the mutual covenants and conditions of the transfer of the Dennis Engel Property and the David Engel Property from the ET J of Schertz to the ET J of New Braunfels and the subsequent annexation of the properties by New Braunfels; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEW BRAUNFELS, TEXAS: SECTION 1: That the draft of the Boundary Agreement attached hereto as Exhibit "1" is hereby approved subject to such minor changes that the City Manager and/or City Attorney deem appropriate; that the City Manager is authorized to execute the Boundary Agreement in behalf of the City of New Braunfels; and the City Manager, City Attorney, and staff are hereby authorized to take all necessary actions to implement the Agreement.
