A gain <strong>of</strong> $70,000 from the sale <strong>of</strong> property and the addition <strong>of</strong> 0.182 acres to the tax<br />

base.<br />

BOARD/COMMISSION RECOMMENDATION:<br />

The Planning Commission held a public hearing on October 12, 2010, and<br />

recommended denial <strong>of</strong> the request by a vote <strong>of</strong> 7-1-0.<br />

STAFF RECOMMENDATION:<br />

Staff does not recommend approval <strong>of</strong> the proposed abandonment <strong>of</strong> 0.182 acres <strong>of</strong><br />

Dunlap Drive right-<strong>of</strong>-way adjacent to Lake Dunlap. The <strong>City</strong> is working hard to obtain<br />

floodplain properties to prevent future flood damage to properties as well as provide the<br />

community with linear parks and open spaces. Selling the right-<strong>of</strong>-way would be<br />

contrary to the <strong>City</strong>'s objective to protect the community from floods and provide open<br />

spaces. Maintaining the property as open space also provides the <strong>City</strong> credit in the<br />

CRS (Community Rating System) program for eligibility <strong>of</strong> reduced flood insurance<br />

rates for the community. In addition, the <strong>City</strong> does not have any other right-<strong>of</strong>-way<br />

access to Lake Dunlap on the south side <strong>of</strong> IH 35 and the east side <strong>of</strong> Lake Dunlap.<br />

The property could potentially be utilized for emergency access to Lake Dunlap.<br />

Should the <strong>City</strong> Council choose to approve the request for abandonment, the <strong>City</strong><br />

Engineer has requested the entire tract be labeled as a drainage easement and NBU<br />

has requested a utility easement.<br />
