Mobile Billboard means a sign installed or displayed on a motor
vehicle or a trailer being towed by a motor vehicle in the public right-ofway
for the purpose of advertising a business or entity that is unrelated to
the owner of the vehicle's primary business. The term does not include a
sign that is displayed or installed on a vehicle operated in the normal
course of the vehicle owner's business, if the sign contains advertising or
identifying information directly related to the business and is not used to
display advertising that is unrelated to the business.
b. Amending Section 106-11 "Prohibited Signs" by adding a new Subsection
(12) which shall hereinafter read as follows:
(12) Mobile billboards except that a mobile billboard operator who is
operating within the City on the effective date of this ordinance and
registers proof of such operation with the City Secretary's Office within
thirty (30) days of the effective date of this ordinance is not subject to the
prohibition until two (2) years after the effective date of the ordinance.
SECTION 2: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable
and, if any phrase, clause, sentence, paragraph or section of this Ordinance should be
declared invalid by the final judgment or decree of any court of competent jurisdiction, such
invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this Ordinance.
SECTION 3: All provisions of the Code of Ordinances of the City of New Braunfels
not herein amended or repealed shall remain in full force and effect. All Ordinances or
parts thereof in conflict herewith are repealed to the extent of such conflict only.
SECTION 4: This Ordinance will take effect upon the second and final reading in
accordance with the provisions of the Charter of the City of New Braunfels.
