<strong>Chapter</strong> 11 – Program Terminations and Program Integrity Unit<br />
[24 CFR Part 982, Subpart B, G, I & K]<br />

Definition of Substantial Under-Reporting: an amount equal to or greater than $2,400 annually.<br />
A Payment Plan Agreement will be prepared based on the amount of underpayment of rent resulting<br />
from the unreported or underreported income. SDHC will determine the retroactive rent as far back as<br />
the existence of complete file documentation (form HUD 50058 and supportive documentation) to<br />
support such retroactive rent determinations.<br />
The participant will be presented with the Payment Plan Agreement and provided an opportunity to<br />
contest the findings.<br />
Based on the all the circumstances in each case, including the seriousness of the violation, SDHC will use<br />
is discretion in terminating assistance or allowing the family to enter into a Payment Plan Agreement<br />
and continue participation.<br />
Families who refuse to enter into a Payment Plan Agreement will be terminated from the Rental<br />
Assistance Program.<br />
Where appropriate, SDHC will refer the case for civil or criminal prosecution.<br />
Q. DEBTS OWED - NATIONAL HUD REPOSITORY [24 CFR 5.233]<br />
HUD maintains a national repository of debts owed to Public <strong>Housing</strong> Agencies or Section 8 landlords<br />
and adverse information of former participants who have voluntarily or involuntarily terminated<br />
participation in the program. The following is how SDHC will comply with HUD’s requirements for<br />
submission and maintenance of information in the Debts Owed database:<br />
1. A “Form HUD-52675” must be completed by all the adult household members prior to the<br />
adverse data being added to the HUD repository, or there is proof that the form was mailed<br />
to the last known address.<br />
2. Any debt or termination information submitted to the database will be based on clear and<br />
complete support documentation. The support documentation will be reviewed and<br />
approved by the Program Integrity Staff. SDHC will use the criteria specified in CFR 982.552<br />
(c), Authority to deny admission or terminate assistance, when determining the<br />
appropriateness of a submission into the HUD repository.<br />
3. Former participants who dispute the information must submit their dispute in writing within<br />
the three-year timeframe allowed by HUD for submitting a formal dispute. If the dispute is<br />
submitted timely, SDHC will evaluate any documentation that is provided to support the<br />
dispute. A written response will be rendered within 30 days of receiving the written<br />
dispute. If SDHC determines that the disputed information is incorrect, SDHC will update or<br />
delete the record.<br />
R. DEBTS DUE FOR CLAIMS [24 CFR 792.103, 982.552 (B)(6-8)]<br />
If a family owes money to the SDHC for claims paid to an owner, SDHC will enter into a Payment<br />
Plan Agreement.<br />
