<strong>Housing</strong> Choice Voucher Homeownership Program<br />
SDHC will also accept families from another HCV Homeownership Program subject to SDHC admission<br />
requirements for the homeownership program. It will administer the voucher if approved for<br />
homeownership.<br />
Q. MOVE WITH CONTINUED TENANT-BASED ASSISTANCE<br />
A family receiving homeownership assistance may move to a new unit with continued assistance. A<br />
family member must not own any title or other interest in the prior home and may not move more than<br />
once per year. SDHC will review all requests to move with continued tenant-based assistance and may<br />
deny permission to move based on lack of sufficient funding to provide continued assistance or based<br />
upon the violations listed in this document.<br />
R. FORECLOSURE OF ASSISTED HOMES<br />
It is the family’s responsibility to notify SDHC if they move into the foreclosure process. Once SDHC is<br />
aware that the foreclosure process has begun, the following steps will be taken:<br />
- The HAP will be placed on hold.<br />
- The family will be contacted to discuss the foreclosure.<br />
- SDHC will work with the family and/or lender to determine when the last mortgage payment was<br />
made.<br />
- A written request will be sent to the family to return all HAP payments made from the date the<br />
last mortgage payment was made.<br />
- A repayment agreement will not be allowed; all funds must be repaid within 30 days from the<br />
date of the request letter.<br />
- If the funds are not returned within that time, the case will be referred to PIU. The family may be<br />
terminated and the debt may be referred to a debt collection agency.<br />
SDHC will review foreclosures on a case-by-case basis to determine whether the family will be allowed<br />
to remain a program participant.<br />
S. TERMINATION OF HOMEOWNERSHIP ASSISTANCE<br />
A family’s homeownership assistance may be terminated if a family fails to comply with its obligations<br />
under the HCV Homeownership Program or if the family defaults on the mortgage.<br />
1. Failure to Comply with Homeowner Obligations<br />
The family must comply with the terms of any mortgage incurred to purchase and/or refinance the<br />
home. The family must provide SDHC with written notice of any sale or transfer of any interest in<br />
the home; any plan to move out of the home prior to the move; notification of the family’s<br />
household composition and income and homeownership expenses on an annual basis; and any<br />
notice of mortgage default received by the family. Except as otherwise specified in this plan, the<br />
family may not convey or transfer the home to any entity or person.<br />
Homeownership assistance may be denied or terminated in accordance with any of the provisions<br />
listed at 24CFR 982.638 and/or SDHC requirements.<br />
