Chapter 8 – Annual Reexaminations and Interim Adjustments [24 CFR Part 982, Subpart I & K] A. INTRODUCTION In accordance with HUD requirements, SDHC will reexamine the income and household composition of all families. Recertifications and interim reexaminations will be processed in a manner that ensures families are given reasonable notice of rent increases. All activities will be coordinated in accordance with HUD regulation. It is a HUD requirement that families report all changes in household composition. This Chapter defines SDHC's policy for conducting annual recertifications and coordinating activities. It also explains the interim reporting requirements for families, and the standards for timely reporting. B. MOVING FORWARD: RECERTIFICATION SCHEDULES Triennial - Participant households where 100 percent of the adult household members either meet HUD’s definition of disabled, are age 55 or older, or have been verified as a full-time student (age 18-23, excluding Head, Spouse or Co-head) will be eligible for the triennial recertification cycle. Each year, one third of the elderly and disabled participants will be scheduled for a full recertification. In the “off” years, a family’s income will be adjusted at the Cost of Living Adjustment (COLA) annual recertification date if the family receives a Cost of Living Adjustment or there is a change in the utility allowance or payment standard. Biennial - Participant households not meeting the requirements of the triennial recertification cycle are considered work-able and subject to the biennial recertification cycle. SDHC will conduct a full recertification of household income and family composition every two years for work-able households. A recertification packet will be mailed to families at least 120 days in advance of the biennial SDHC has established appropriate recertification procedures necessary to ensure the income data provided by families is complete and accurate. Families are required to complete the recertification packet as a condition of continued program participation. The Personal Declaration form ensures the income data provided by families are complete and accurate. SDHC has established procedures to gather information and data necessary to complete the biennial recertification. The procedures require the participation and signatures of all adult family members, 18 years and older, and family members who will turn 18 years of age by the effective date of the recertification. When interviews are scheduled, all adult family members and family members who will turn 18 years of age by the effective date of the recertification must attend. Failure to provide requested information and data and or failure to attend scheduled appointments may result in termination of eligibility. SDHC will have all required recertifications within the current biennial cycle completed at least 30 days before the biennial certification date. Families will be notified at least 30 days before the scheduled date of any increase to the rent portion. The HUD Form 50058 will be completed and transmitted as required by HUD. The Notice of Rent Change is mailed to the owner and the family. Signatures are not required by SDHC. If the family disagrees with the rent adjustment, the family may request an administrative review by following the procedures stated on the Notice of Intended Action Rent Portion letter. 8-1

D. NON-MOVING FORWARD: REGULAR ANNUAL RECERTIFICATIONS [24 CFR 982.516] Families are required to complete an annual recertification of income, assets, allowances, and deductions. 1. Recertification Notice to the Family SDHC will maintain a recertification tracking system and the household will normally be notified by mail at least 120 days in advance of the anniversary date. 2. Completion of Annual Recertification of Income SDHC will have all annual recertifications for families completed before the anniversary date. This includes notifying the family of the portion of the rent. Families will be notified at least 30 days before the scheduled date of the increase in their rent. 3. Collection of Information [24 CFR 982.516(f)] SDHC has established appropriate recertification procedures necessary to ensure that the income data provided by families is complete and accurate. SDHC will require the family to complete a Personal Declaration form. E. NON-MOVING FORWARD: COMPLIANCE WITH ANNUAL RECERTIFICATION PROCESS SDHC establishes procedures to gather information and data necessary to complete the annual recertification.
