14. If a person nominates and asks someone to perform Hajj Badal<br />

on his behalf but the nominated person performs Hajj Tamattu’,<br />

he has to return the expenses in this case (Fatāwā Razawiyyaĥ<br />

referenced, vol. 10, pp. 660) because the Iḥrām for Hajj Tamattu’ will<br />

not commence from the Mīqāt of the sender, instead it will be<br />

put on from the Ḥaram border. However, if Hajj Tamattu’ was<br />

performed with the consent of the one on whose behalf Hajj<br />

was performed, there is no harm in it.<br />

15. If the one to whom the deceased made the will to get Hajj<br />

Badal done on his behalf sends someone from any other place<br />

to perform Hajj Badal despite having one third part of the<br />

deceased’s wealth which is sufficient to send someone from the<br />

deceased’s own town, Hajj Badal will not be valid in this case.<br />

However, if that town is so near to the deceased’s town that one<br />

can go and return within the same day before night falls, Hajj<br />

Badal wo<strong>ul</strong>d be valid in this case. Otherwise, he (i.e. the one to<br />

whom will was made) sho<strong>ul</strong>d arrange to repeat Hajj Badal on<br />

behalf of the deceased from his own money. (‘Ālamgīrī, vol. 1, pp. 259;<br />

Rad-d<strong>ul</strong>-Muḥtār, vol. 4, pp. 27)<br />

16. The intention of the performer of Hajj Badal has to be the same<br />

as that of the one who has commanded him. It is even better to<br />

say<br />

(i.e. I am in attendance on behalf of so and so<br />

person). If he has forgotten the name of that person, he sho<strong>ul</strong>d<br />

make the intention that he is performing Hajj on behalf of the<br />

one for whom he has been sent. (Rad-d<strong>ul</strong>-Muḥtār, vol. 4, pp. 20)<br />

The performer of Hajj Badal sho<strong>ul</strong>d mention the name of the one on whose behalf<br />

he is performing Hajj in lieu of saying ‘so and so person’. For instance, he sho<strong>ul</strong>d say<br />
