Offences and their Expiations 185<br />

of Hajj or ‘Umraĥ in the state of uncleanness or without Wuḍū or<br />

has cut the grass of Ḥaram - double expiation will not be imposed<br />

on him in these cases because these acts are forbidden not because<br />

of Iḥrām but rather these are forbidden in Ḥaram and are Wājib in<br />

Hajj and ‘Umraĥ.<br />

has stated f<strong>ul</strong>l details of this r<strong>ul</strong>ing:<br />

Under the r<strong>ul</strong>es, if a Mufrid commits any of such acts forbidden<br />

due to Iḥrām he is required to pay one Dam or Ṣadaqaĥ. If a Qārin<br />

or the one considered Qārin in terms of r<strong>ul</strong>ings commits such an act<br />

he has to pay two Dams or Ṣadaqāt because of putting on the Iḥrām<br />

of both Hajj and ‘Umraĥ but there are certain conditions in which<br />

even a Qārin is required to pay only one Dam or Ṣadaqaĥ etc. (The<br />

reason for it is that those certain acts are not forbidden due to Iḥrām.)<br />

1. If a person intending to perform Hajj and ‘Umraĥ passes Mīqāt<br />

without Iḥrām and puts on Iḥrām of Hajj Qirān at the place<br />

where he has reached instead of coming back, he is required to<br />

pay only Dam because he has committed a forbidden act before<br />

he had put on the Iḥrām of Hajj Qirān.<br />

2. If a Qārin or the one considered Qārin in terms of r<strong>ul</strong>ings has cut<br />

a tree of Ḥaram, he is required to pay only one penalty because<br />

cutting trees of Ḥaram is not forbidden because of Iḥrām.<br />

3. If a person who has made a Shar’ī vow to go to perform Hajj or<br />

‘Umraĥ on foot departed on some conveyance to perform Hajj<br />

Qirān, for example, during the days of Hajj he is required to pay<br />

one Dam (because of travelling by the vehicle).<br />

4. If someone performed Ṭawāf-uz-Ziyāraĥ in the state of<br />

uncleanness or without Wuḍū, only one penalty will be paid<br />

because the acts forbidden in Ṭawāf-uz-Ziyāraĥ are confined
