Biofuels: Promotion and relevant legislation<br />

The Biofuel Quotas Act (Biokraftstoffquot<strong>en</strong>gesetz) of 2007 required the oil industry to market<br />

a growing perc<strong>en</strong>tage of biofuels governed by a quota system. There are quotas both for admixtures<br />

to fossil fuels and for the perc<strong>en</strong>tage of total motor fuels marketed. Admixtures of<br />

biofuels to fossil motor fuels are promoted by the biofuels quota, whereas pure biofuels <strong>en</strong>joy<br />

tax concessions outside the quota on a decreasing scale. Since 2010, assistance under the Biofuels<br />

Sustainability Ordinance has dep<strong>en</strong>ded on whether their production can be shown to<br />

m<strong>ee</strong>t certain sustainable cultivation requirem<strong>en</strong>ts. In concrete terms, this means in particular<br />

that biofuels only count towards the quota or <strong>en</strong>joy tax concessions if their gr<strong>ee</strong>nhouse<br />

gas reduction pot<strong>en</strong>tial is at least 35 %. With effect from 2015, the biofuels quota will also be<br />

based on the gr<strong>ee</strong>nhouse gas reduction.<br />

The biofuels share of total motor fuel consumption (excluding water and air traffic) in Germany<br />

was 5.8 % in 2010, and thus fell short of the statutory quota of 6.25 % valid for the period<br />

2010 to 2014.<br />

Under the EU Directive on the promotion of the use of <strong>en</strong>ergy from r<strong>en</strong>ewable sources, a<br />

binding minimum figure of 10 % for r<strong>en</strong>ewables in the transport sector is laid down for every<br />

EU Member State for the year 2020, as is the introduction of sustainability standards. This<br />

quota does not have to be covered <strong>en</strong>tirely by biofuels, however. The r<strong>en</strong>ewables perc<strong>en</strong>tage<br />

in the electric mobility sector also counts.<br />
