Carlisle District Local Plan 2001 - 2016 Revised Redeposit draftLocal authorities have a responsibility under the Countryside and Rights of Way (CRoW) Act2000 to take reasonable steps to further the conservation and enhancement of the featuresfor which an SSSI has been notified.Special Area of Conservation (SAC)Areas established under the EU Directive on the Conservation of Natural Habitats and ofWild Fauna and Flora as contributing to the maintenance of a coherent Community-widenetwork of habitats called Natura 2000. SAC’s are selected for their contribution to thesurvival of species and habitats of European importance. The areas proposed as SACs arealso SSSIs.Special Protection Area (SPA)Areas established under the EC Directive on the Conservation of Wild Birds in orderto safeguard habitats of migrating birds and certain threatened species and thereby toconserve populations. All SPA’s are also SSSI’s.Strategic Employment SitesStrategic Employment Sites are defined in the Structure Plan as large sites of a minimumof eight hectares, designed specifically to provide sites for large scale business, generalindustry, storage and distribution uses. The site should be close to the primary road network.Small scale uses would not normally be permitted on such sites.Supplementary Planning Guidance/Document (SPG/SPD)This is a document adopted by the City Council which sets out additional details in relationto a Local Plan Policy. The document must be linked to a policy of the Local Plan.Sustainable DevelopmentThe Bruntland Report in 1987 brought a new approach when it proposed that anon-going balance could be struck between economic growth and the needs of theenvironment through the concept of sustainable development. A definition of this concept is‘development that meets the needs of the present without compromising the ability of futuregenerations to meet their own needs.’Sustainable Drainage Systems (SuDS)A sequence of management practices and control structures designed to drain surfacewater in a more sustainable way than some conventional techniques. SuDS manage surfacewater on site as near to source as possible by slowing down the rate of run-off and treatingit naturally through such design techniques as porous pavements, infiltration trenches andbasins, french drains, swales and passive treatment systems including filter strips, detentionbasins, retention ponds and wetlands. This approach will allow the release of good qualitysurface water into watercourses and the groundwater resource.Tree Preservation Order (TPO)Under Section 198 of the 1990 Act a Local Planning Authority may, in the interests ofamenity, make provisions for the preservation of individual trees or woodlands. TPOsprohibit the cutting down, topping, lopping, uprooting, wilful damage or wilful destructionof trees without the prior consent of the Authority.146 September 2006

The change of use of landor buildings, from one class to another, normally requires planning permission. The changeof use of land or buildings within a particular Class does not involve development requiringplanning permission.Class B1:Business Use including offices (other than those falling in Class A2 Financial andProfessional services), research and development and industrial processes, providing the usecan be carried out in any residential area without detriment to amenity by reason of noise,vibration, smell, fumes, smoke, soot, ash, dust or grit.Class B2:General IndustrialClass B8:Storage or Distribution warehouses including wholesale cash and carry.Wildlife SitesCumbria Wildlife Trust designates some sites, which do not meet the criteria set out byEnglish Nature for SSSI’s, as Wildlife Sites. They contain examples of important habitats withuncommon species of plants and animals.Windfall SiteAn informal term used to describe a site where planning consent (usually for housing) isgranted despite that site not being allocated for development in the Local Plan.World Heritage SitesThe World Heritage Convention from which World Heritage Sites derive was ratified by theUK in 1984. The Convention provides for the identification, protection, conservation andpresentation of cultural and natural sites of outstanding universal value. Hadrian’s WallMilitary Zone was designated as a World Heritage Site in 1987.September 2006 147
