<strong>Carlisle</strong> <strong>District</strong> <strong>Local</strong> <strong>Plan</strong> 2001 - 2016 Revised Redeposit draft5.68 This policy should also take into account the need for these homes to be affordable to theirspecific market.POLICY H14 Gypsies and TravellersWhere there is an identified need the <strong>City</strong> <strong>Council</strong> will consider the provision of Gypsyand Traveller Sites. Proposals for Gypsy and Traveller sites will be acceptable providingthat:1. The proposal will not compromise the objectives of the designation of an Area ofOutstanding Natural Beauty or Landscape of County Importance; and2. there would be no adverse impact on the local landscape; and3. appropriate access and parking can be achieved; and4. the proposed site is reasonably accessible to community services; and5. the proposal would not adversely affect the amenities of adjacent occupiers byway of noise, vehicular or other activities on site.5.69 The Criminal Justice and Public Order Act 1994 repealed certain provisions of theCaravanSites Act 1968 and removed the statutory obligation for <strong>Local</strong> Authorities to providesites for Gypsies and Travellers resorting to or residing in their area.5.70 It is expected that this will lead to more applications for private sites. In determining theseplanning applications the <strong>Council</strong> will have regard to constraints in the <strong>Plan</strong> and sites willbe restricted in areas of environmental value. The <strong>City</strong> <strong>Council</strong> will continue to monitor thenumber of Gypsy and Travellers caravans in the <strong>District</strong> biannually, so as to assess the needfor additional sites. In considering applications for additional sites the views of the Gypsyand Traveller population and Central Government guidelines will be taken into account.POLICY H15 Travelling ShowpeopleThe provision of winter quarters for Travelling Showpeople for residential purposes and themaintenance of fairground equipment will be assessed against the following criteria:1. the proposal is not within an area of Outstanding Natural Beauty or CountyLandscape; and2. there would be no adverse impact on the local landscape; and3. appropriate access and parking can be achieved; and4. the proposal is reasonably accessible to community services; and5. the proposal would not adversely affect the amenities of adjacent occupiers by way ofnoise, vehicular or other activities on site.Proposals must also be in accordance with other relevant policies within the <strong>Local</strong> <strong>Plan</strong>.5.71 The existing site on Devonshire Walk car park is the favoured location for the temporaryaccommodation of caravans and equipment for the duration of the operation of fairsvisiting <strong>Carlisle</strong>. Whilst Travelling Showpeople enjoy permitted development rights whentravelling for purposes of their business, planning restrictions can be imposed on morepermanent, longer term means of accommodation on sites commonly referred to as ‘winterquarters’. A permanent site is located at Willowholme. Should the need arise the <strong>City</strong><strong>Council</strong> will seek to identify potential additional sites where possible for ‘winter quarters’.Proposals however will only be considered acceptable where they are compliant with otherpolicies within the <strong>Local</strong> <strong>Plan</strong>.September 2006 87
