<strong>Carlisle</strong> <strong>District</strong> <strong>Local</strong> <strong>Plan</strong> 2001 - 2016 Revised Redeposit draftNeeds to demonstrate that it does not involve inappropriate intrusion into the opencountryside and will not affect the character of surrounding buildings. Could requireto demonstrate there will no adverse effects on biodiversity or cultural heritage. (SeePolicies CP1, CP5, LE6-12).4.39 Use Classes A3, A4 and A5 includes restaurants, public houses, wine bars and takeaways.All these attract significant numbers of customers and are open during the evenings. The<strong>Council</strong> is keen to see an early evening and late night economy evolve in <strong>Carlisle</strong> butrecognise that this creates potential conflicts. As such, these uses have the potential not onlyto introduce variety of activity into town centres, but also to cause significant disturbance tooccupants of surrounding residential property. Any proposals which involves unreasonabledisturbance will be opposed. Certain developments such as public houses or restaurantsrequire adequate access and car parking arrangements and these will be required inappropriate developments.4.40 Such facilities are normally located in the centre of <strong>Carlisle</strong>, Brampton and Longtown,neighbourhood or village centres. Where the proposal relates to the conversion of anexisting building it will be acceptable, provided the proposal meets the above criteria, otherpolicies of the <strong>Plan</strong> and provided there is no adverse effect on the character of the building.4.41 In the case of restaurants and takeaways, restrictions on opening hours will be imposed.Within the <strong>Plan</strong> area actual opening times will depend upon the character of thesurrounding area, other neighbouring uses and the likely disturbance to the occupiers ofresidential property. In addition because of the nature of the outlet they will require theinstallation of adequate grease traps to avoid foul drainage blockages affecting nearbypremises.POLICY EC11 Rural DiversificationDevelopment proposals to diversify and expand upon the range of economic activitiesundertaken in rural areas will be encouraged where the proposal re-uses or adaptsexisting traditional buildings (of permanent construction) for commercial, industrialor recreational uses. Any new building required as part of a diversification schememust be well related to an existing group of buildings to minimise its impact, blendingsatisfactorily into the landscape through the use of suitable materials, design and siting.Proposals should:1. Be complementary to or compatible with the agricultural operations in the ruralarea; and2. Be compatible with the character and scale of the operation and its landscapecharacter; and3. Not lead to an increase in traffic levels beyond the capacity of the surroundinglocal highway network; and4. Be capable of providing adequate access and parking arrangements.Conversion of premises (of permanent construction) to live/work units will be acceptableproviding that they maintain the character of the original building and be in the regionof 60% residential to 40% employment use. Permission for later conversion of theemployment part will not be acceptable unless replacement employment use is providedin adjacent premises.September 2006 57
