4. The conditions laid down in<br />

Article 43 (2) and (4) EEA call for<br />

a complex assessment of various<br />

macroeconomic factors. <strong>EFTA</strong><br />

States must therefore enjoy a<br />

wide margin of discretion, both in<br />

determining whether the conditions<br />

are fulfilled and in the choice of<br />

measures taken, as those measures<br />

in many cases concern fundamental<br />

choices of economic policy.<br />

5. The measures in the case at<br />

hand, prohibition of importation<br />

of offshore icelandic krónur, were<br />

adopted to prevent transactions<br />

which would cause serious and<br />

substantial monetary and exchange<br />

rate instability. The critical<br />

situation that existed in iceland<br />

after the financial crash in late<br />

2008, satisfied the substantive<br />

requirements for applying the<br />

derogation clause at the time when<br />

the prohibition on importation<br />

of offshore krónur was adopted<br />

(October 2009), as well as when the<br />

Plaintiff in the national proceedings<br />

was finally denied an exemption<br />

from the prohibition (October<br />

2010). Furthermore, the contested<br />

measures were in accordance with<br />

the principle of proportionality,<br />

and did not either contravene the<br />

principle of legal certainty.<br />
