alia, with regard to ensuring a<br />

high level of health and consumer<br />

protection.<br />

4. Accordingly, the EEA States<br />

retain the competence to take<br />

disciplinary action and impose<br />

criminal sanctions against migrant<br />

medical professionals and,<br />

where appropriate, to suspend<br />

or withdraw the authorisation to<br />

practise if the respective conditions<br />

under national law are fulfilled,<br />

provided that the general principles<br />

of EEA law are respected.<br />

5. However, the requirements on<br />

the pursuit of a profession must<br />

reflect objective criteria known in<br />

advance. They must adequately<br />

circumscribe the exercise of the<br />

national authorities’ discretion,<br />

so that it is not used arbitrarily,<br />

thereby eliminating discretionary<br />

conduct liable to deprive the<br />

Directive of its full effectiveness.<br />

Furthermore, the requirements<br />

which an EEA State may impose<br />

must be non-discriminatory, able to<br />

ensure achievement of the objective<br />

of protecting public health and not<br />

go beyond what is necessary for<br />

that purpose. This is for the EEA<br />

State concerned to demonstrate.<br />

6. Provided that the relevant<br />

information that led to the refusal<br />

of the complainant’s application<br />

would have given grounds for<br />

a suspension or withdrawal<br />

of an existing authorisation in<br />

compliance with EEA law, national<br />

authorities cannot be obliged to<br />

grant an authorisation when there<br />

is a necessity to revoke it. Under<br />

such circumstances, national<br />

authorities must be entitled to deny<br />

an authorisation.<br />
