SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOSEstas con<strong>de</strong>nas fueron parte <strong>de</strong> un proceso más amplio seguido contra 17 integrantes <strong>de</strong>l pueblomapuche acusados, entre otros <strong>de</strong>litos, <strong>de</strong> incendio terrorista; asociación ilícita terrorista, robocon intimidación, homicidio frustrado y atentado contra la autoridad. Salvo los cuatro comunerosseñalados, todos los <strong>de</strong>más fueron absueltos tras un largo periodo en que estuvieron sometidos a prisiónpreventiva.El <strong>INDH</strong> hizo seguimiento al juicio que con<strong>de</strong>nó a los cuatro comuneros con el objeto <strong>de</strong> verificar elrespeto al cumplimiento <strong>de</strong> las garantías <strong>de</strong>l <strong>de</strong>bido proceso, el principio <strong>de</strong> igualdad y no discriminaciónsobre la base <strong>de</strong> pertenencia étnica y las condiciones carcelarias que cumplían bajo prisión preventiva loscuatro sometidos a proceso. En el recurso <strong>de</strong> nulidad interpuesto ante la Corte Suprema por la DefensoríaPenal Pública por la con<strong>de</strong>na <strong>de</strong> estas personas, el <strong>Instituto</strong> <strong>Nacional</strong> <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong> presentó unamicus curiae dando a conocer las razones jurídicas que apoyaban la moción <strong>de</strong> nulidad, amparadas, porcierto, en los principios y garantías <strong>de</strong>l <strong>de</strong>recho internacional <strong>de</strong> los <strong>de</strong>rechos humanos y en el or<strong>de</strong>namientojurídico interno.La Sala Penal <strong>de</strong> la Corte Suprema acogió parcialmente la nulidad y dictó una sentencia <strong>de</strong> reemplazo querebajó ostensiblemente las penas en un marco <strong>de</strong> <strong>de</strong>claraciones realizadas por el presi<strong>de</strong>nte <strong>de</strong> la CorteSuprema, Milton Juica, que señaló: “nuestra posición en general es crítica respecto a que exista una leyantiterrorista en nuestro sistema <strong>de</strong>mocrático <strong>de</strong>biese ser corregida, modificada y atenuada en sus efectosy asegurar el <strong>de</strong>bido proceso, es <strong>de</strong>cir, que todos los procesos sean <strong>de</strong> la misma manera para todos losjusticiables”.Las cuatro con<strong>de</strong>nas fueron dictadas en el contexto <strong>de</strong> una segunda huelga <strong>de</strong> hambre iniciada en marzo<strong>de</strong>l 2011 y que se mantuvo por un periodo <strong>de</strong> ochenta y siete días, finalizando con motivo <strong>de</strong> la creación<strong>de</strong> la Comisión por los <strong>Derechos</strong> <strong>de</strong>l Pueblo Mapuche, conformada por un representante <strong>de</strong> la IglesiaCatólica, familiares <strong>de</strong> los mapuche encarcelados y el <strong>Instituto</strong> <strong>Nacional</strong> <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong>. LaComisión tuvo entre sus objetivos promover una reforma efectiva <strong>de</strong> la Ley 18.314, <strong>de</strong> manera que seajuste a los estándares internacionales, y analizar las obligaciones que <strong>de</strong>be cumplir el Estado <strong>de</strong> Chile enmateria <strong>de</strong> reclusión <strong>de</strong> personas pertenecientes a pueblos indígenas <strong>de</strong> conformidad a lo establecidoen el artículo 10 <strong>de</strong> <strong>de</strong>l Convenio 169 <strong>de</strong> la OIT. Se propuso, para avanzar en este objetivo, un plazo <strong>de</strong>nueve meses y un sistema <strong>de</strong> audiencias públicas en diferentes zonas <strong>de</strong>l país para que, junto a un trabajocon autorida<strong>de</strong>s y parlamentarios, diera a luz a una nueva modificación <strong>de</strong> la ley. Estamos en eso.De igual manera, en el año 2010 y con gran <strong>de</strong>spliegue comunicacional y mediático, se inició el llamado“Caso Bombas” que procesó a dieciséis personas por conductas terroristas consistentes en la <strong>de</strong>tonación<strong>de</strong> artefactos explosivos contra propiedad privada y pública. De ellas catorce quedaron sometidasa prisión preventiva. Nuevamente el <strong>Instituto</strong> realizó misiones <strong>de</strong> observación en las audienciaspreparatorias y <strong>de</strong> formalización, <strong>de</strong>nunció la improce<strong>de</strong>ncia <strong>de</strong> su aplicación para el caso y laincompatibilidad <strong>de</strong> la ley con las garantías que <strong>de</strong>be otorgar el Estado en materias <strong>de</strong> <strong>de</strong>bido proceso.14
SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOSJunto con ello representó también las severas condiciones carcelarias a las que fueron sometidos losprocesados en cárceles <strong>de</strong> máxima seguridad. Asimismo, asistimos en calidad <strong>de</strong> observadores a la mesaconstituida para tales efectos, que contó con la participación <strong>de</strong> parlamentarios, autorida<strong>de</strong>s eclesiásticasy abogados <strong>de</strong>fensores. En octubre <strong>de</strong> 2011, el caso dio un giro al dictarse, respecto a uno <strong>de</strong> losprincipales <strong>de</strong>litos perseguidos por el Ministerio Público -el <strong>de</strong> asociación ilícita terrorista-, elsobreseimiento <strong>de</strong>finitivo respecto <strong>de</strong> once imputados.Durante el mes <strong>de</strong> agosto <strong>de</strong>l 2011, la Comisión Interamericana <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong> (CIDH)presentó una <strong>de</strong>manda ante la Corte Interamericana <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong> en el caso<strong>de</strong> Segundo Aniceto Norín Catrimán, Juan Patricio Marileo Saravia, Victor Ancalaf Llaupey otros vs. Chile. En su Informe <strong>de</strong> Fondo la CIDH concluyó que tanto la formación normativa,como la aplicación selectiva <strong>de</strong> la ley antiterrorista a miembros <strong>de</strong>l pueblo mapucherepresentan una seria afectación a <strong>de</strong>rechos consagrados en la Convención Americana <strong>de</strong> <strong>Derechos</strong><strong>Humanos</strong>. En ambos casos, el resultado <strong>de</strong> la aplicación <strong>de</strong> la ley antiterrorista ha sido que un númeroimportante <strong>de</strong> personas formalizadas por <strong>de</strong>litos terroristas han quedado finalmente absueltas <strong>de</strong>spués<strong>de</strong> un largo periodo <strong>de</strong> prisión preventiva.La legislación antiterrorista, representa una <strong>de</strong> las respuestas <strong>de</strong> mayor intensidad punitiva <strong>de</strong>ntro <strong>de</strong>lsistema penal, merece un juicio <strong>de</strong> reproche en términos <strong>de</strong> <strong>de</strong>rechos humanos, en consi<strong>de</strong>ración,básicamente, a tres razones:1° Mantiene una <strong>de</strong>ficiente <strong>de</strong>finición <strong>de</strong> <strong>de</strong>lito terrorista que vulnera los principios <strong>de</strong> legalidad y tipicidad;2° En materia <strong>de</strong> garantías judiciales establece normas excepcionales que afectan al <strong>de</strong>recho al <strong>de</strong>bidoproceso, particularmente en materia <strong>de</strong> privación <strong>de</strong> libertad y obtención <strong>de</strong> pruebas a través <strong>de</strong> testigos;3° En su aplicación práctica se observa un patrón <strong>de</strong> conducta que violenta el principio <strong>de</strong> igualdad y nodiscriminación por su invocación preferente y selectiva a grupos discriminados <strong>de</strong> la sociedad.No me cabe duda que la presente jornada abordará <strong>de</strong> manera clara y precisa estos y otros temas atingentes.Espero que las conclusiones a que se lleguen, permitan contar con más antece<strong>de</strong>ntes <strong>de</strong> hecho y <strong>de</strong><strong>de</strong>recho que contribuyan a generar el consenso necesario para reformar la ley <strong>de</strong> manera que sea consistentecon los estándares en materia <strong>de</strong> <strong>de</strong>rechos humanos.Muchas gracias.15
