SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOS<strong>de</strong>sarrollando indígenas en el marco <strong>de</strong>l conflicto <strong>de</strong> recuperación <strong>de</strong> sus territorios ancestralesy porque no lograba compren<strong>de</strong>rse en qué medida se podía atentar contra la <strong>de</strong>mocracia y contra<strong>de</strong>rechos humanos fundamentales. Consi<strong>de</strong>rando, a<strong>de</strong>más, que hay una legislación penal común que esmuy a<strong>de</strong>cuada para tales efectos, las penas para esos incendios son gravísimas.Posteriormente han existido una serie <strong>de</strong> reformas. Sobre todo <strong>de</strong>spués <strong>de</strong> los atentados <strong>de</strong>l 11 <strong>de</strong>septiembre <strong>de</strong> 2001 vino una avalancha <strong>de</strong> reformas en virtud <strong>de</strong> las cuales se trató <strong>de</strong> a<strong>de</strong>cuar la normativaantiterrorista pero, siguiendo lo que fue la tónica <strong>de</strong> los europeos en este punto más bien se atacaronlas bases económicas y financieras <strong>de</strong>l terrorismo. Estamos hablando <strong>de</strong>l año 2003. No teníamos ningunanecesidad <strong>de</strong> crear un tipo penal <strong>de</strong> financiamiento <strong>de</strong>l terrorismo, pero se creó. Importante es que seadoptó la resolución 1373 <strong>de</strong>l Consejo <strong>de</strong> Seguridad <strong>de</strong> Naciones Unidas, se promulgó el Conveniopara la represión <strong>de</strong> atentados terroristas cometidos con bomba y la Convención Interamericana contrael terrorismo. Ahora, la última reforma, o la penúltima reforma fue el año pasado en diciembre <strong>de</strong> 2010 através <strong>de</strong> la Ley 24.480 y <strong>de</strong>spués hubo una reforma en junio <strong>de</strong> este año 2011, muy cortita, pero que vinoa precisar ciertas cosas <strong>de</strong> la reforma anterior. Ahora, ¿en cuánto se giró en torno a dos ejes fundamentalesen esta última reforma el concepto <strong>de</strong> terrorismo <strong>de</strong> la mano <strong>de</strong> los bienes jurídicos protegidos y en losaspectos procedimentales los intentos por introducir una normativa procesal muy propia <strong>de</strong> las legislacionescontra el narcotráfico en la i<strong>de</strong>a <strong>de</strong> que el terrorismo era crimen organizado? Hablo <strong>de</strong> la última reformasabiendo que habrá una mesa referida a temas específicos <strong>de</strong> la reforma, pero me voy a referir sobre loque creo son sus núcleos problemáticos.En cuanto al concepto <strong>de</strong> terrorismo la legislación actual, reformada, no logra a<strong>de</strong>cuarse al conceptoconstitucional <strong>de</strong> terrorismo así como tampoco al que se establece en la mayoría <strong>de</strong> tratados internacionalesque se refieren a la materia. Hay discrepancia en los tratados internacionales en relación a eso, y esasdiscrepancias se producen porque en la mayoría <strong>de</strong> ellos se habla <strong>de</strong> que el terrorismo es un atentadocontra la <strong>de</strong>mocracia. En otros se dice que es un atentado contra la <strong>de</strong>mocracia o una finalidad políticao, a<strong>de</strong>más, se tiene la finalidad <strong>de</strong> intimidar como ocurre con el Convenio Marco <strong>de</strong>l Consejo <strong>de</strong> Europa.Pero, en general diría que la mayoría <strong>de</strong> los tratados internacionales reconoce la finalidad política.Esta reforma tampoco consi<strong>de</strong>ra los límites que los tratados internacionales imponen, especialmenteel Convenio para la represión <strong>de</strong> atentados terroristas cometidos con bomba y la propia ConvenciónInteramericana contra el terrorismo, en el entendido <strong>de</strong> que nada <strong>de</strong> lo que se diga en estos tratados pue<strong>de</strong>ser interpretado para restringir <strong>de</strong>rechos fundamentales, lo dice expresamente el articulo 14 <strong>de</strong>l Conveniopara la represión <strong>de</strong> atentados terroristas cometidos con bomba y el articulo 15 <strong>de</strong> la ConvenciónInteramericana contra el terrorismo. Yo creo que aquí se han hecho interpretaciones restrictivas <strong>de</strong> estostratados para atentar contra <strong>de</strong>rechos fundamentales. No diría para atentar pero sí que llevan comoconsecuencia eso. En ese sentido, esta reforma continúa <strong>de</strong>sconociendo la finalidad política y se contentacon consi<strong>de</strong>rar que el terrorismo se caracteriza por los efectos o resultados <strong>de</strong> alarma pública que se42
SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOScausa, o sea, mantiene el elemento subjetivo <strong>de</strong> causar temor en la población o parte <strong>de</strong> ella al ser víctima<strong>de</strong> <strong>de</strong>litos <strong>de</strong> la misma especie. Si bien se eliminó la presunción <strong>de</strong> finalidad terrorista que operaba cuandose usaban en el <strong>de</strong>lito ciertos medios catastróficos y eso tiene una cosa buena. Viene a salvar un problema<strong>de</strong> inconstitucionalidad manifiesta que tenía la ley. Pero, también, hay que señalar que esa eliminaciónno tuvo ningún efecto real. Porque por ese mismo problema <strong>de</strong> inconstitucionalidad, ningún tribunal nidurante la dictadura ni durante los sucesivos gobiernos <strong>de</strong>mocráticos, ningún tribunal aplicó nunca lapresunción. O sea, inmediatamente cuando algún tribunal <strong>de</strong> instancia quería aplicar la presunción, la Corte<strong>de</strong> Apelaciones, sobre todo la <strong>de</strong> Santiago, echaba para atrás las presunciones porque <strong>de</strong>cía que esto erainconstitucional. Ahora más, en nuestros propios tiempos, el propio Tribunal Oral en lo Penal <strong>de</strong> Angolque sí ha con<strong>de</strong>nado por <strong>de</strong>litos <strong>de</strong> terrorismo, ese mismo Tribunal dijo en una oportunidad: “no vamosa aplicar la presunción porque es inconstitucional, porque no se a<strong>de</strong>cua al artículo 5° inciso segundo <strong>de</strong>la Constitución”. Por lo tanto, no vino a salvar ningún problema real. Lo que sí tenía la presunción es que<strong>de</strong>s<strong>de</strong> el momento que hacía referencia a los medios catastróficos, permitía un criterio al juez para po<strong>de</strong>ri<strong>de</strong>ntificar cuando una conducta era terrorista. Entonces, hoy día, al haber <strong>de</strong>saparecido la referencia almedio catastrófico, las conductas terroristas se pue<strong>de</strong>n <strong>de</strong>sarrollar por cualquier medio. O sea, así las cosaspodría suce<strong>de</strong>r que un <strong>de</strong>lito <strong>de</strong> terrorismo se verificara mediante piedras, cuchillos, hondas, palos, o sea,un medio que carece <strong>de</strong> toda capacidad para po<strong>de</strong>r llevar a<strong>de</strong>lante una estrategia <strong>de</strong> violación masiva ysistemática <strong>de</strong> <strong>de</strong>rechos humanos, con lo cual nos vamos alejando <strong>de</strong>l concepto <strong>de</strong> terrorismo. O por lomenos <strong>de</strong> ciertos acuerdos mínimos a los que se han llegado en el ámbito internacional.La reforma también eliminó como hipótesis alternativa la <strong>de</strong> arrancar <strong>de</strong>cisiones a la autoridad o imponerexigencias. Pero, ésa hipótesis pasa a formar parte <strong>de</strong> la manera <strong>de</strong> probar la concurrencia <strong>de</strong> la finalidad<strong>de</strong> causar temor, a<strong>de</strong>más, se amplía a la <strong>de</strong> inhibir resoluciones a la autoridad.No se trata <strong>de</strong> afirmar que todos los <strong>de</strong>litos <strong>de</strong> terrorismo necesariamente <strong>de</strong>ben ser cometidos conmedios catastróficos, con bombas, pero sí <strong>de</strong> guardar un mínimo <strong>de</strong> razonabilidad en los tipos penalespara impedir <strong>de</strong>finitivamente <strong>de</strong> que el terrorismo se convierta en este cajón <strong>de</strong> sastre don<strong>de</strong> puedacaber cualquiera. Porque <strong>de</strong> acuerdo a la actual redacción, un estudiante que lanza una bomba molotoven el marco <strong>de</strong> una manifestación estudiantil para exigir gratuidad <strong>de</strong> la educación pública según el fiscal<strong>de</strong> turno pue<strong>de</strong> ser consi<strong>de</strong>rado terrorista. O un obrero que lanza piedras contra el Transantiago en elmarco <strong>de</strong> una manifestación para exigir mejoras salariales, también pue<strong>de</strong> ser consi<strong>de</strong>rado terrorista enfunción <strong>de</strong> la opinión <strong>de</strong>l operador <strong>de</strong>l sistema penal que le toque. Los ciudadanos no po<strong>de</strong>mos quedara la buena o mala merced <strong>de</strong> la interpretación <strong>de</strong> los operadores <strong>de</strong>l sistema penal cuando <strong>de</strong> lo quese trata es <strong>de</strong> <strong>de</strong>litos tan graves. Es <strong>de</strong>cir que nos consi<strong>de</strong>ren un homo sacer, un apartado <strong>de</strong> la sociedadporque potencialmente todos somos <strong>de</strong>stinatarios <strong>de</strong> esta ley. No porque vayamos a estar todos tirandobombas molotov sino porque el procedimiento <strong>de</strong> la ley antiterrorista es tan gravoso que nos pue<strong>de</strong>alcanzar. Por ejemplo, si usted tiene un hijo que ha sido formalizado por conductas terroristas pue<strong>de</strong> verintervenidas sus comunicaciones. Ese es el peligro.43
