SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOSLa segunda justificación para una cuidadosa y a<strong>de</strong>cuada <strong>de</strong>finición <strong>de</strong>l <strong>de</strong>lito <strong>de</strong> terrorismo a nivel nacionaltiene sus raíces en el <strong>de</strong>recho internacional <strong>de</strong> los <strong>de</strong>rechos humanos; es <strong>de</strong>cir, en el artículo 15 <strong>de</strong>l PactoInternacional <strong>de</strong> <strong>Derechos</strong> Civiles y Políticos, que no se pue<strong>de</strong> suspen<strong>de</strong>r ni siquiera en tiempos <strong>de</strong>emergencia pública. Esto implica que la exigencia <strong>de</strong> responsabilidad penal se limite a disposiciones clarasy precisas en la ley, a fin <strong>de</strong> respetar los principios <strong>de</strong> legalidad y seguridad jurídica y asegurar que no serásujeta a interpretación que podría ampliar el alcance <strong>de</strong> la conducta prohibida.La <strong>de</strong>finición mo<strong>de</strong>lo <strong>de</strong>l terrorismo se ha elaborado en este contexto, en ausencia <strong>de</strong> una <strong>de</strong>finicióncomprensiva y acotada <strong>de</strong>l terrorismo aceptada universalmente y reconocida a nivel internacional,teniendo en cuenta los elementos contenidos en el Párrafo 3 <strong>de</strong> la resolución 1566 (2004) <strong>de</strong>l Consejo<strong>de</strong> Seguridad.Ya que estamos en Chile y el programa <strong>de</strong>l seminario hace referencia a ello, me permito <strong>de</strong>stacar quemi pre<strong>de</strong>cesor, a través <strong>de</strong> la comunicación conjunta enviada con el Relator Especial sobre los <strong>de</strong>rechos<strong>de</strong> los pueblos indígenas, James Anaya, ha expresado su preocupación por la Ley N° 18.314 y otras leyesespeciales, tanto con respecto a una <strong>de</strong>finición <strong>de</strong>masiado amplia <strong>de</strong> terrorismo y el efecto que laaplicación <strong>de</strong> las leyes ha tenido en la práctica. Estaría muy bienvenido si <strong>de</strong>l impulso <strong>de</strong> este seminariose pudiera contribuir a una reforma <strong>de</strong> estas leyes, en particular <strong>de</strong> la <strong>de</strong>finición <strong>de</strong>l <strong>de</strong>lito <strong>de</strong> terrorismocomprendida en la Ley N° 18.314, <strong>de</strong> acuerdo con las recomendaciones <strong>de</strong> otros mecanismos <strong>de</strong> <strong>de</strong>rechoshumanos como el Comité <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong> y el Comité sobre la Eliminación <strong>de</strong> la DiscriminaciónRacial, entre otros.El mandato que me ha otorgado el Consejo <strong>de</strong> <strong>Derechos</strong> <strong>Humanos</strong> y la Asamblea General me pi<strong>de</strong> hacerrecomendaciones concretas sobre la promoción y protección <strong>de</strong> los <strong>de</strong>rechos humanos y las liberta<strong>de</strong>sfundamentales en la lucha contra el terrorismo, a petición <strong>de</strong> los Estados, a través <strong>de</strong> la prestación <strong>de</strong>servicios <strong>de</strong> asesoría o asistencia técnica en esta materia.Estoy dispuesto a prestar tales servicios si el Gobierno <strong>de</strong> Chile así lo <strong>de</strong>sea. Tal emprendimiento podríaformar parte <strong>de</strong> una visita al país, en misión oficial. Por lo tanto, quiero agra<strong>de</strong>cer al Gobierno <strong>de</strong> Chile,representado aquí hoy, por haberme indicado antes <strong>de</strong> asumir mis funciones como Relator Especial, quetal misión podría realizarse durante el año 2012.Señoras y señores, permítanme referirme ahora a una segunda área <strong>de</strong> mejores prácticas que en mi opiniónmerece refinación y elaboración. La práctica 6 propone un mo<strong>de</strong>lo <strong>de</strong> prestación <strong>de</strong> reparaciones y asistenciaa las víctimas <strong>de</strong>l terrorismo y, esencialmente, pi<strong>de</strong> a los Estados compensar a las víctimas tanto <strong>de</strong> lasmedidas contra el terrorismo y <strong>de</strong> los actos terroristas, a través <strong>de</strong> fondos provenientes <strong>de</strong>l presupuesto<strong>de</strong>l Estado.52
SEMINARIO INTERNACIONAL, TERRORISMO Y ESTÁNDARES EN DERECHOS HUMANOSSoy consciente <strong>de</strong>l hecho <strong>de</strong> que algunos Estados rechazan la i<strong>de</strong>a <strong>de</strong> que existe una obligación internacional<strong>de</strong> <strong>de</strong>rechos humanos para in<strong>de</strong>mnizar a las víctimas <strong>de</strong> actos terroristas a partir <strong>de</strong> los presupuestos<strong>de</strong>l Estado, incluso si el acto <strong>de</strong> terrorismo, que se lleva a cabo por agentes no estatales, no pue<strong>de</strong> serlegalmente atribuido al Estado.Por ejemplo, esto podría ser por no cumplir con su obligación <strong>de</strong> proteger el <strong>de</strong>recho a la vida <strong>de</strong> todaslas personas bajo su jurisdicción y/o por no llevar a los perpetradores <strong>de</strong> actos terroristas a la justicia <strong>de</strong>una manera compatible con los <strong>de</strong>rechos humanos, o para llevar a cabo investigaciones sobre las posiblesacusaciones <strong>de</strong> no haber prevenido esos actos.Esto es sólo una <strong>de</strong> las razones por las que pretendo <strong>de</strong>dicar parte <strong>de</strong> mi próximo informe al Consejo <strong>de</strong><strong>Derechos</strong> <strong>Humanos</strong> a la explicación <strong>de</strong> lo que quiero <strong>de</strong>cir con respecto a los <strong>de</strong>rechos <strong>de</strong> las víctimas<strong>de</strong>l terrorismo, como fue señalado en mi informe a la Asamblea General. Consi<strong>de</strong>ro que la incorporación<strong>de</strong> las obligaciones <strong>de</strong>l Estado hacia las víctimas <strong>de</strong>l terrorismo refleja la aceptación por la comunidadinternacional <strong>de</strong>l hecho <strong>de</strong> que cualquier estrategia sana, sostenible y comprensiva para combatir elterrorismo requiere el reconocimiento <strong>de</strong>l sufrimiento <strong>de</strong> las víctimas <strong>de</strong> actos terroristas.Tengo la intención <strong>de</strong> abordar el tema con referencia a los siguientes cuatro pilares:1. Las obligaciones positivas y negativas <strong>de</strong> los Estados para proteger y promover el <strong>de</strong>recho a la vida;2. Las obligaciones <strong>de</strong> los Estados <strong>de</strong> investigar a los autores <strong>de</strong> los <strong>de</strong>litos <strong>de</strong> terrorismo, y para llevara cabo investigaciones prontas, exhaustivas, in<strong>de</strong>pendientes e imparciales <strong>de</strong> toda <strong>de</strong>nuncia plausiblerelacionada con la inteligencia u otros errores operativos en la prevención <strong>de</strong> un acto terrorista;3. Las responsabilida<strong>de</strong>s <strong>de</strong> los Estados <strong>de</strong> in<strong>de</strong>mnizar y rehabilitar a las víctimas <strong>de</strong>l terrorismo(in<strong>de</strong>pendiente <strong>de</strong> si esa responsabilidad refleja una obligación jurídica internacional), y4. Los <strong>de</strong>beres <strong>de</strong> los Estados <strong>de</strong> prevenir el terrorismo al abordar seriamente las condicionespropicias para su propagación, <strong>de</strong> acuerdo a un enfoque basado en los <strong>de</strong>rechos humanos (entreotras cosas garantizando la rendición <strong>de</strong> cuentas, y la erradicación <strong>de</strong> violaciones <strong>de</strong> <strong>de</strong>rechoshumanos en la lucha contra el terrorismo, uno <strong>de</strong> los factores importantes que contribuyen a lapropagación <strong>de</strong>l mismo).Es esencial que la protección <strong>de</strong> los <strong>de</strong>rechos humanos <strong>de</strong> las víctimas <strong>de</strong>l terrorismo sea visto como ungenuino <strong>de</strong>ber jurídico que recae principalmente en los Estados, y que no se utilice como pretexto paraviolar los <strong>de</strong>rechos humanos <strong>de</strong> los sospechosos <strong>de</strong> terrorismo, para tomar medidas <strong>de</strong> emergencia queestablecen po<strong>de</strong>res excesivos y <strong>de</strong>sproporcionados, o para otros objetivos <strong>de</strong> carácter político.53
