de seguros pueden ser hechas sin la aprobación o contra el deseo<br />
del asegurador, exigiendo así del reasegurador, según las condiciones<br />
del contrato realizado, seguir la suerte del asegurador. Podemos<br />
citar, como ejemplo, aquella operada por la transferencia<br />
del bien y del consecuente seguro sobre él celebrado, a la luz del<br />
artículo Nº 785 1 del Código Civil, en el cual la alteración de las condiciones<br />
del riesgo, aún con la reserva de su no aceptación, no son<br />
de conocimiento del reasegurador. Otro claro ejemplo de alteración<br />
del riesgo original, por motivos ajenos al reasegurador, es el<br />
aumento de los valores por siniestros en virtud de la variación y la<br />
tasa de cambio de las divisas del país; ya que determinadas coberturas<br />
suscritas con tasas de cambio inferiores a aquellas utilizadas<br />
para el pago de las indemnizaciones afectarán fuertemente los desembolsos<br />
del reasegurador.<br />
Dicho sea de paso, es importante que se hagan algunas distinciones<br />
en tales casos. Mientras el reasegurador básicamente sigue<br />
la suerte del asegurador, en estas circunstancias, ya que los eventos<br />
descritos están fuera de control de este último, el principio de<br />
seguir la suerte solamente se aplica en relación a las condiciones<br />
estipuladas en el contrato de reaseguros.<br />
Para impedir desequilibrios originados por intervención legislativa<br />
o estatal, capaces de imponer obligaciones al segurador distintas<br />
de aquellas objeto del contrato de reaseguro original y derivado<br />
del concepto de seguir la suerte, ya sea en sustancia o en<br />
volumen, se establece la cláusula conocida como hechos vigentes<br />
o alteraciones de las normas, estipuladas a veces en los contratos<br />

On one hand, some alterations affecting insurance agreements<br />
may be inserted without the insurer’s consent, or even against its<br />
wish, so that reinsurers shall be required to follow the fortunes,<br />
pursuant to the conditions of the relevant agreement.We could<br />
mention, for instance, alterations resulting from assignment of<br />
goods and of the relevant insurance agreement for coverage<br />
thereof, as provided under article 785 1 of the Civil Code, according<br />
to which any alteration in the risk conditions, even if it is not<br />
agreed, is unknown to reinsurers.As another clear example of<br />
alterations in original risks for other reasons than those concerning<br />
reinsurers, we could refer to the increase of payable values of<br />
claims due to ex<strong>change</strong> rate variations inside the country. In this<br />
case, some coverage underwritings obtained at ex<strong>change</strong> rates<br />
lower than those used for the payment of losses shall significantly<br />
affect sums to be reimbursed by reinsurers.<br />
Nevertheless, it is worthy to emphasize some differences noted<br />
in these events. While reinsurers basically follow insurer’ fortunes,<br />
in these circumstances concerning events beyond the control of<br />
this latter, the follow the fortunes principle shall only apply to<br />
conditions agreed under reinsurance treaties.<br />
By occasionally using a clause known as current facts or<br />
alterations of rules in non-proportional treaties, the contracting<br />
parties try to avoid any unbalance arising from legislative or state<br />
intervention, that would be likely to create any obligations to<br />
insurers other than those agreed under the original treaty and<br />
derived from the follow the fortunes concept, either in substance or<br />
