(1) Any time <strong>the</strong>re are discovered any corpus delicti, an investigator and prosecutor shall, within<br />
<strong>the</strong>ir authorities, institute prosecution and shall take all actions provided by law in order to<br />
determine circumstances <strong>of</strong> <strong>the</strong> crime and persons who committed <strong>the</strong> crime.<br />
(2) Investigator and prosecutor shall ensure <strong>the</strong> right <strong>of</strong> <strong>the</strong> victim <strong>of</strong> a crime to access justice.<br />
Article 25. Appeal From Procedural Actions and Decisions<br />
(1) Actions and decisions <strong>of</strong> <strong>the</strong> agency <strong>of</strong> preliminary investigation, <strong>the</strong> investigator, and<br />
prosecutor may be appealed as provided herein.<br />
(2) The convicted person has <strong>the</strong> right to appeal from <strong>the</strong> verdict to <strong>the</strong> higher court as provided<br />
herein.<br />
(3) The convicted person has <strong>the</strong> right to ask for pardon or mitigation <strong>of</strong> <strong>the</strong> sentence.<br />
CHAPTER 3. ACCUSATION<br />
Article 26. Cases for Personal, Personal-and-Public, and Public Accusation<br />
(1) Depending on <strong>the</strong> character and gravity <strong>of</strong> <strong>the</strong> committed crime, criminal prosecution and<br />
accusation in court may be ‘personal’, ‘personal and public’, and ‘public’.<br />
(2) Cases for personal accusation include crimes stipulated by Article 110, part two <strong>of</strong> Article<br />
112, part one <strong>of</strong> Article 126, Articles 127, 128, Article 134, Article 135, part one and two <strong>of</strong><br />
Article 136, part one <strong>of</strong> Article 137, part one <strong>of</strong> Article 139, Articles 140, 141, 146, 150, 151,<br />
178, 194, part one <strong>of</strong> Article 324.<br />
<strong>Criminal</strong> prosecution on such cases may be initiated only by <strong>the</strong> complaint <strong>of</strong> <strong>the</strong> victim<br />
and shall be dismissed upon reconciliation <strong>of</strong> <strong>the</strong> parties. Reconciliation may take place only<br />
before <strong>the</strong> verdict comes into effect.<br />
(3) Cases for personal-and-public accusation include minor misdemeanors and misdemeanors<br />
stipulated by Articles 10 and 11 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>, and <strong>of</strong>fenses<br />
stipulated by Article 129/Part 1 and Article 130/Part 1 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong><br />
<strong>Republic</strong>.<br />
(4) All o<strong>the</strong>r <strong>of</strong>fenses shall be considered cases for public accusation.<br />

Article 27. Right <strong>of</strong> Persons to Participate in <strong>Criminal</strong> Proceedings and Accusation<br />
(1) The victim or, in case <strong>of</strong> his death or inability due to age or health express his personal will<br />
in <strong>the</strong> course <strong>of</strong> criminal proceedings, any <strong>of</strong> his adult close relative has <strong>the</strong> right to<br />
participate in criminal proceedings as provided herein, and—in cases for personal<br />
accusation—to suggest and support <strong>the</strong> charge against <strong>the</strong> defendant. The victim or his<br />
representative may refuse to support <strong>the</strong> charge any time during criminal proceedings.<br />
(2) Refusal <strong>of</strong> <strong>the</strong> prosecutor to charge shall not preclude <strong>the</strong> victim from <strong>the</strong> right to support<br />
accusation.<br />
