(1) The Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall review <strong>the</strong> res judicata verdicts <strong>of</strong> courts <strong>of</strong><br />

primary and appellate jurisdiction on <strong>the</strong> basis <strong>of</strong> complaints <strong>of</strong> <strong>the</strong> parties <strong>of</strong> criminal<br />

procedure and on <strong>the</strong> basis <strong>of</strong> petitions <strong>of</strong> prosecutors.<br />

(2) The Panel <strong>of</strong> Judges on <strong>Criminal</strong> Cases and Cases <strong>of</strong> Administrative Offences <strong>of</strong> <strong>the</strong><br />

Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall review <strong>the</strong> verdicts <strong>of</strong> court <strong>of</strong> primary and<br />

appellate jurisdiction.<br />

(3) The Presidium <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall review <strong>the</strong> verdicts <strong>of</strong> court <strong>of</strong><br />

cassational jurisdiction.<br />

(4) If <strong>the</strong> criminal case that was filed to <strong>the</strong> Supreme Court was not earlier examined in appellate<br />

and cassational orders, <strong>the</strong>n it shall be <strong>the</strong> subject along with <strong>the</strong> complaint and petition to<br />

filing to <strong>the</strong> corresponding jurisdiction for examination.<br />

(5) During <strong>the</strong> examination <strong>of</strong> case in reviewing procedure <strong>the</strong> court shall not be binded only by<br />

<strong>the</strong> court arguments stated in <strong>the</strong> complaint and petition, and it shall be authorized to examine<br />

<strong>the</strong> criminal procedure in corpore.<br />

(6) If several persons are convicted according to <strong>the</strong> criminal case and <strong>the</strong> complaint or petition<br />

to review res judicata verdict was submitted by only one <strong>of</strong> <strong>the</strong>m or concerning some <strong>of</strong><br />

<strong>the</strong>m, <strong>the</strong>n <strong>the</strong> court reviewing res judicata verdicts shall examine <strong>the</strong> criminal case in respect<br />

<strong>of</strong> all convicted.<br />

(7) The court reviewing res judicata verdicts during <strong>the</strong> examination <strong>of</strong> <strong>the</strong> criminal case on res<br />

judicata verdict shall be authorized to mitigate <strong>the</strong> sentence in respect <strong>of</strong> convicted or apply a<br />

criminal law on less heavy crime.<br />

(8) The effect <strong>of</strong> this part was revoked by <strong>the</strong> decision <strong>of</strong> Constitutional Court <strong>of</strong> <strong>Kyrgyz</strong><br />

<strong>Republic</strong> dated 13 January 2006.<br />

Article 374-1. The court reviewing <strong>the</strong> criminal cases on complaints and petitions on <strong>the</strong><br />

rulings <strong>of</strong> district (city) courts which had come into legal force Excluded by <strong>the</strong> Law <strong>of</strong> KR<br />

dated 8 August 2004 #111<br />

Article 375. Appellation <strong>of</strong> Court Injunctions that have become res judicata.<br />

(1) The convict, his/her legal representative and defender, as well as <strong>the</strong> victim and his/her legal<br />

representative, civil plaintiff, civil defendant and <strong>the</strong>ir representatives shall have <strong>the</strong> right to<br />

file a complaint, and <strong>the</strong> prosecutor who has participated in <strong>the</strong> case hearing and a superior<br />

prosecutor—a petition, to Supreme Court <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>, regional and court equal to<br />

it. The prosecutor’s petition may be suspended before <strong>the</strong> Court trial by a superior<br />

prosecutor.<br />

(2) Complaints and petition shall be reviewed by <strong>the</strong> court within no longer than two month from<br />

<strong>the</strong> date <strong>the</strong>y filed with.<br />

Article 376. Grounds for Reviewing Court Decisions that Became Res Judicata<br />

(1) Grounds for reviewing verdicts, rulings, resolutions that have become res judicata are:
