(4) The suspect enjoys some o<strong>the</strong>r rights and carries o<strong>the</strong>r responsibilities provided herein.<br />

(5) Any time a suspect is brought to temporary detention isolation ward, and each time he, his<br />

council, relatives appeal from physical assault from <strong>of</strong>ficers <strong>of</strong> preliminary investigation and<br />

investigation, he should be obligatory medically examined with records <strong>of</strong> examination.<br />

Administration <strong>of</strong> <strong>the</strong> temporary detention isolation ward shall be responsible for medical<br />

examination.<br />

Article 41. Accused, defendant, convicted<br />

(1) The accused is a person who was decided to be charged with <strong>the</strong> crime, by a resolution in <strong>the</strong><br />

order provided herein.<br />

(2) The accused whose case undergoes court proceedings shall be called <strong>the</strong> defendant, <strong>the</strong><br />

defendant in whose respect <strong>the</strong> verdict was announced shall be called <strong>the</strong> convicted.<br />

Article 42. Rights and Responsibilities <strong>of</strong> <strong>the</strong> Accused, defendant, convicted (acquitted)<br />

(1) The accused has <strong>the</strong> right to:<br />

1) get copies <strong>of</strong> resolution on his charge, on appointment <strong>of</strong> an expert;<br />

2) make statements on <strong>the</strong> crime he is charged with or refuse to make statements;<br />

3) introduce evidence;<br />

4) make motions and challenges;<br />

5) testify and speak his native language or <strong>the</strong> language he knows;<br />

6) use services <strong>of</strong> a translator and also <strong>of</strong> an attorney, including cases <strong>of</strong> prosecutor’s review<br />

<strong>of</strong> investigator’s petition (resolution) on choosing <strong>the</strong> preventive measure in <strong>the</strong> form <strong>of</strong><br />

taking into custody;<br />

7) participate in investigational proceedings if requested by him or by his defense attorney;<br />

8) study reports <strong>of</strong> <strong>the</strong> expert;<br />

9) communicate with his counsel confidentially and without limitation <strong>of</strong> time and number<br />

<strong>of</strong> meetings;<br />

10) study <strong>the</strong> dossier <strong>of</strong> <strong>the</strong> case after <strong>the</strong> investigation and write out <strong>the</strong> information<br />

concerning <strong>the</strong> charge brought against him;<br />

11) make petitions against actions <strong>of</strong> <strong>the</strong> preliminary investigator, actions and decisions <strong>of</strong><br />

investigator, prosecutor.<br />

(2) <strong>the</strong> defendant has <strong>the</strong> right to participate in court proceedings in courts <strong>of</strong> primary, and enjoy<br />

all rights <strong>of</strong> a party <strong>of</strong> <strong>the</strong> trial, as well as <strong>the</strong> right for <strong>the</strong> last word, to appeal from <strong>the</strong><br />

actions and decisions <strong>of</strong> <strong>the</strong> court.<br />

(3) The accused shall:<br />

1) appear when summoned by an agency performing investigation;<br />

2) when in custody, agree to personal search;<br />

3) agree to medical examination, dactyloscoping, taking his picture, taking his blood test,<br />

taking tests <strong>of</strong> his secretions;<br />

4) obey orders <strong>of</strong> <strong>the</strong> investigator, prosecutor.
