investigator or prosecutor). The record shall contain information on <strong>the</strong> applicant, place <strong>of</strong><br />

his residence and work.<br />

(3) Any applicant shall be warned about criminal responsibility for an intentionally false<br />

accusation and <strong>the</strong>re shall be an entry on that in <strong>the</strong> transcript <strong>of</strong> proceedings certified with<br />

<strong>the</strong> applicants’ signature.<br />

Article 152. Report <strong>of</strong> someone pleading guilty<br />

(1) Report <strong>of</strong> someone pleading guilty is a voluntary statement <strong>of</strong> a person on prepared crime,<br />

criminal attempt, or <strong>the</strong> committed by him crime when it is not yet known to <strong>the</strong> agency <strong>of</strong><br />

preliminary investigation, investigator, or prosecutor.<br />

(2) Report <strong>of</strong> someone pleading guilty may be made both in oral and written forms and shall be<br />

filed by an applicant with <strong>the</strong> agency <strong>of</strong> preliminary investigation, investigator or prosecutor.<br />

Any oral report shall be compiled in a transcript <strong>of</strong> proceedings that shall contain a detailed<br />

description <strong>of</strong> a made statement. The transcript <strong>of</strong> proceedings shall be signed by a person<br />

who pleaded guilty and an <strong>of</strong>ficial who received a report.<br />

Article 153. Statement <strong>of</strong> an <strong>of</strong>ficial <strong>of</strong> an organization<br />

(1) Statement <strong>of</strong> an <strong>of</strong>ficial <strong>of</strong> an organization on a crime shall be made in a written form.<br />

(2) Some documents and o<strong>the</strong>r materials that prove circumstances <strong>of</strong> <strong>the</strong> committed crime may<br />

be enclosed with <strong>the</strong> statement.<br />

Article 154. Mass Media Information<br />

(1) Mass media information may be a ground for institution <strong>of</strong> prosecution when it is published<br />

in a newspaper or a magazine or spread by radio or television.<br />

(2) Officials <strong>of</strong> a mass media agency that published or spread information on a crime, on a<br />

request <strong>of</strong> <strong>the</strong> person authorized to institute prosecution shall transfer documents and o<strong>the</strong>r<br />

materials that are in <strong>the</strong>ir disposal and prove published or broadcast made information and<br />

name <strong>the</strong> source <strong>of</strong> information except for cases when with person who provided <strong>the</strong><br />

information made it on a condition <strong>of</strong> confidentiality.<br />

Article 155. Obligation <strong>of</strong> Acceptance and Consideration <strong>of</strong> Reports and Statements on<br />

Crimes<br />

(1) Any agency <strong>of</strong> preliminary investigation, investigator and prosecutor shall accept, register<br />

and consider a report or a statement on <strong>the</strong> committed or planned crime. Any applicant shall<br />

be given a document on registration <strong>of</strong> <strong>the</strong> accepted report or statement that shall specify <strong>the</strong><br />

person who received a report or statement, its registration.<br />

(2) Unmotivated waiver <strong>of</strong> report or statement on a crime may be appealed to a prosecutor or<br />

court according to <strong>the</strong> procedure established by Articles 131 and 132 <strong>of</strong> this <strong>Code</strong>.<br />

(3) Any report or statement received by court shall be filed with a prosecutor and <strong>the</strong> applicant<br />

shall be notified on that.
