video, and audio coverage may be used. Stenography, records <strong>of</strong> <strong>the</strong> films, pictures, and<br />

audio and video tapes shall be kept toge<strong>the</strong>r with <strong>the</strong> dossier <strong>of</strong> <strong>the</strong> case.<br />

(3) The transcript <strong>of</strong> proceedings shall specify <strong>the</strong> place and date <strong>of</strong> <strong>the</strong> investigational<br />

proceeding, time <strong>of</strong> its beginning and completion, <strong>the</strong> name <strong>of</strong> <strong>the</strong> person who compiled <strong>the</strong><br />

transcript <strong>of</strong> proceedings, full name <strong>of</strong> each person participating in <strong>the</strong> proceeding and, if<br />

necessary, <strong>the</strong>ir addresses. The transcript <strong>of</strong> proceedings shall describe procedural actions<br />

according to <strong>the</strong> sequence that took place in reality, discovered in its enforcement essential<br />

facts as well as reports <strong>of</strong> persons who participated in <strong>the</strong> proceeding.<br />

(4) If in <strong>the</strong> course <strong>of</strong> <strong>the</strong> investigatory proceeding photography, video and audio coverage was<br />

used or moulds, finger prints, blueprints, charts, plans were made, <strong>the</strong> record shall also<br />

specify technical devices applied in <strong>the</strong> course <strong>of</strong> <strong>the</strong> investigatory proceeding, conditions<br />

and procedure for <strong>the</strong>ir utilization, objects to which <strong>the</strong> devices were applied and <strong>the</strong><br />

received results. The transcript <strong>of</strong> proceedings shall also specify that all persons participating<br />

in proceeding were notified beforehand on <strong>the</strong> application <strong>of</strong> <strong>the</strong> technical device.<br />

(5) The transcript <strong>of</strong> proceedings shall be submitted for acknowledgment to all persons<br />

participating in <strong>the</strong> investigatory proceeding. They shall be explained <strong>the</strong>ir right to make<br />

remarks that shall be recorded in <strong>the</strong> transcript <strong>of</strong> proceedings. The registered in <strong>the</strong><br />

transcript <strong>of</strong> proceedings remarks, additions and changes shall be specified in <strong>the</strong> transcript<br />

<strong>of</strong> proceedings and certified with signatures <strong>of</strong> those persons.<br />

(6) The transcript <strong>of</strong> proceedings shall be signed by <strong>the</strong> investigator, <strong>the</strong> interrogated person,<br />

interpreter, specialist and o<strong>the</strong>r persons who participated in <strong>the</strong> investigatory proceeding.<br />

(7) The transcript <strong>of</strong> proceedings shall be enclosed with negatives and pictures, video tapes,<br />

slides, audio and video cassettes, blueprints, charts, plans, moulds, and finger prints made in<br />

<strong>the</strong> course <strong>of</strong> <strong>the</strong> investigatory proceeding.<br />

(8) When <strong>the</strong>re are grounds to believe that it is necessary to protect a victim, his representative,<br />

witness or <strong>the</strong>ir relatives, <strong>the</strong> investigator shall be authorized not to specify information on<br />

<strong>the</strong>m in <strong>the</strong> transcript <strong>of</strong> proceedings <strong>of</strong> <strong>the</strong> investigatory proceeding. In this case <strong>the</strong><br />

investigator shall render a resolution in which he shall disclose reasons for his decision to<br />

keep in secret <strong>the</strong> information on participant <strong>of</strong> <strong>the</strong> investigational proceeding, identify his<br />

pseudonym and model <strong>of</strong> his signature that he is going to use in transcript <strong>of</strong> proceedings on<br />

investigatory actions with his participation. The resolution shall be placed into a glued<br />

envelope which, apart from <strong>the</strong> investigator, may be disclosed only by a supervising<br />

prosecutor or a judge.<br />

Article 171. Certification <strong>of</strong> <strong>the</strong> Fact <strong>of</strong> Refusal to Sign or Impossibility to Sign <strong>the</strong><br />

Transcript <strong>of</strong> Investigational Proceedings<br />

(1) If <strong>the</strong> suspect, accused, witness or o<strong>the</strong>r person refuses to sign <strong>the</strong> action transcript <strong>of</strong><br />

investigational proceedings an entry on that shall be made in <strong>the</strong> transcript <strong>of</strong> proceedings<br />

that shall be certified with a signature <strong>of</strong> <strong>the</strong> person who enforced <strong>the</strong> investigational<br />

proceeding.<br />

(2) Any person who refuses to sign a transcript <strong>of</strong> proceedings shall be given a possibility to<br />

provide an explanation on <strong>the</strong> reasons <strong>of</strong> his refusal and an entry on that shall be made in <strong>the</strong><br />

transcript <strong>of</strong> proceedings.<br />

(3) If it is impossible for <strong>the</strong> suspect, accused, victim or wittiness to sign <strong>the</strong> record <strong>of</strong> his<br />

interrogation because <strong>of</strong> being physically disabled or due to his health condition, <strong>the</strong>
