7) be reimbursed for his expenses incurred during <strong>the</strong> proceedings on <strong>the</strong> criminal case, and<br />

for damages caused unlawfully by actions <strong>of</strong> <strong>the</strong> agency conducting <strong>the</strong> criminal<br />

proceedings;<br />

8) receive back <strong>the</strong> property seized by <strong>the</strong> agency conducting <strong>the</strong> criminal proceedings as<br />

exhibits for <strong>the</strong> trial or on <strong>the</strong> o<strong>the</strong>r grounds and <strong>the</strong> originals <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial documents<br />

belonging to him;<br />

9) have a defense attorney when interrogated.<br />

(2) Witness shall:<br />

1) appear when summoned by <strong>the</strong> investigator, prosecutor, court;<br />

2) truthfully report all that he knows regarding <strong>the</strong> case and answer questions;<br />

3) not divulge, without <strong>the</strong> permission <strong>of</strong> <strong>the</strong> interrogator, <strong>the</strong> information about <strong>the</strong><br />

circumstances <strong>of</strong> <strong>the</strong> case that are known to him;<br />

(3) When <strong>the</strong> witness fails to appear without justifiable reasons, he may be brought to court and<br />

fined in <strong>the</strong> amount <strong>of</strong> up to two minimum monthly salaries as provided herein by Articles<br />

120 and 121.<br />

(4) For perjury and for refusal or evasion to testify, <strong>the</strong> witness shall be liable in accordance with<br />

Article 330 and 331 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>.<br />

Article 62. Expert<br />

(1) Expert is a person not personally interested in <strong>the</strong> criminal case, assigned by <strong>the</strong> investigator,<br />

<strong>the</strong> court or, if requested by <strong>the</strong>m, by <strong>the</strong> head <strong>of</strong> <strong>the</strong> expert institution to decide issues, which<br />

occur during investigation or trial with <strong>the</strong> use <strong>of</strong> specific knowledge in science, technology,<br />

art, pr<strong>of</strong>ession and give <strong>the</strong> conclusion on this basis. Expert may be assigned from <strong>the</strong> list <strong>of</strong><br />

persons suggested by <strong>the</strong> participants <strong>of</strong> <strong>the</strong> criminal proceedings on <strong>the</strong> case or invited by<br />

<strong>the</strong> parties.<br />

(2) Expert shall possess <strong>the</strong> specific knowledge in science, technology, art, pr<strong>of</strong>ession enough to<br />

make <strong>the</strong> conclusion on <strong>the</strong> presented questions;<br />

(3) A person may not be assigned or o<strong>the</strong>rwise summoned to <strong>the</strong> proceedings on <strong>the</strong> criminal<br />

case as an expert on legal issues;<br />

(4) When <strong>the</strong>re is a necessity, <strong>the</strong>re may be several experts assigned on <strong>the</strong> case;<br />

(5) Summons <strong>of</strong> expert, his assignment and proceedings <strong>of</strong> <strong>the</strong> expert examination shall be<br />

accomplished pursuant to this Chapter.<br />

Article 63. Rights and Duties <strong>of</strong> an Expert<br />

(1) Expert has <strong>the</strong> right to:<br />

1) study <strong>the</strong> materials <strong>of</strong> <strong>the</strong> case relevant to <strong>the</strong> subject matter <strong>of</strong> <strong>the</strong> expert examination;<br />

2) receive objects and materials necessary for <strong>the</strong> comparative analysis and for making his<br />

conclusion;<br />

3) ask for additional materials necessary for making his conclusion or for conducting<br />

additional examination with participation <strong>of</strong> o<strong>the</strong>r experts;<br />

4) refuse to make <strong>the</strong> conclusion if <strong>the</strong> presented questions are beyond his specific<br />

competence;<br />

5) be present during <strong>the</strong> proceeding <strong>of</strong> <strong>the</strong> investigative actions and ask questions relevant to<br />

<strong>the</strong> subject matter <strong>of</strong> <strong>the</strong> expert examination carried out by him;<br />

6) participate in <strong>the</strong> court proceedings regarding <strong>the</strong> subject matter <strong>of</strong> <strong>the</strong> expert<br />

examination;<br />

(2) Expert shall:<br />

1) appear when summoned by <strong>the</strong> investigator or <strong>the</strong> court;<br />

2) give objective answers to questions placed before him;<br />

3) not divulge materials <strong>of</strong> <strong>the</strong> investigation;
