Article 226. The procedure for a case dismissal<br />
(1) Any investigator shall compile a motivated resolution on a case dismissal that shall provide<br />
information on <strong>the</strong> personality <strong>of</strong> <strong>the</strong> accused, disclose <strong>the</strong> merits <strong>of</strong> <strong>the</strong> case and <strong>the</strong> grounds for<br />
its dismissal with substantiation <strong>of</strong> evidence and reference to <strong>the</strong> pages <strong>of</strong> a case.<br />
(2) The resolution shall resolve an issue <strong>of</strong> exhibits in accordance with <strong>the</strong> rules <strong>of</strong> Article 88 <strong>of</strong><br />
this <strong>Code</strong> and a penalty reversal as well as measures for providing a civil claim and property<br />
confiscation.<br />
(3) The resolution shall be signed by <strong>the</strong> investigator and shall specify <strong>the</strong> place and time <strong>of</strong> its<br />
compiling.<br />
(4) Any investigator shall file a copy <strong>of</strong> <strong>the</strong> resolution on a case dismissal with a prosecutor and<br />
at <strong>the</strong> same time notify a person against whom criminal proceedings were instituted, a victim and<br />
an agency on <strong>the</strong> report <strong>of</strong> which a criminal case was initiated, it shall specify <strong>the</strong> grounds for<br />
dismissal and appeal right explanation.<br />
(5) On a request <strong>of</strong> a civil plaintiff and defendant, a victim or <strong>the</strong>ir representatives <strong>the</strong><br />
investigator, a prosecutor shall acknowledge <strong>the</strong>m with <strong>the</strong> materials <strong>of</strong> a dismissed case.<br />
Article 227. Appeal <strong>of</strong> a resolution on a criminal case dismissal<br />
Investigator’s resolution on a criminal case dismissal may be appealed by <strong>the</strong> accused, his<br />
defense attorney, a victim and his representative, civil plaintiff, defendant and <strong>the</strong>ir<br />
representatives as well as a person or a representative <strong>of</strong> an establishment upon report <strong>of</strong> which a<br />
criminal case was initiated, prosecutor who enforced review in <strong>the</strong> course <strong>of</strong> investigation and in<br />
court.<br />
Article 228. Reinstitution <strong>of</strong> Proceeding<br />
(1) The discontinued proceeding may be reinstituted by <strong>the</strong> resolution <strong>of</strong> <strong>the</strong> prosecutor, should<br />
<strong>the</strong> resolution <strong>of</strong> <strong>the</strong> investigator to discontinue <strong>the</strong> proceeding be abrogated.<br />
(2) The proceedings may be reinstituted only in <strong>the</strong> instances where prescriptive terms for<br />
initiation <strong>of</strong> criminal proceedings have not expired.<br />
(3) The notice on reinstitution <strong>of</strong> <strong>the</strong> proceeding shall be served to <strong>the</strong> defendant in <strong>the</strong> case,<br />
defense counsel, victim and his/her representative, civil plaintiff, civil defendant, and <strong>the</strong>ir<br />
representatives, and an individual or an institution, by whose petition <strong>the</strong> proceedings were<br />
initiated.<br />
CHAPTER 29. REFERRAL OF CRIMINAL CASE TO PROSECUTOR<br />
Article 229. Familiarization <strong>of</strong> Victim, Civil Plaintiff, Civil Defendants and Their<br />
Representatives with Case File<br />
(1) The investigator shall familiarize <strong>the</strong> victim or his/her representative, civil plaintiff, civil<br />
defendant, or representatives <strong>the</strong>re<strong>of</strong>, with <strong>the</strong> entire case file, or with a part <strong>the</strong>re<strong>of</strong>, which<br />
<strong>the</strong>se persons wish to familiarize with.
