(2) Documents may contain information both in writing and viva voce. Documents may be<br />

photos and movies, sound and video records received, requested or supplied in compliance<br />

with this <strong>Code</strong> and considered evidence for <strong>the</strong> case.<br />

(3) Documents shall be attached to <strong>the</strong> case dossier during <strong>the</strong> whole time <strong>of</strong> storage. If required<br />

for accounting, reports or o<strong>the</strong>r legal purposes, documents seized and attached to <strong>the</strong> dossier<br />

<strong>of</strong> <strong>the</strong> case may be returned to <strong>the</strong>ir owners or given for temporal use provided that it will not<br />

cause any harm to <strong>the</strong> criminal case, or <strong>the</strong>ir copies shall be made.<br />

(4) Documents shall be considered exhibits if <strong>the</strong>y have <strong>the</strong> attributes specified in Article 85 <strong>of</strong><br />

this <strong>Code</strong>.<br />

Article 90. Records <strong>of</strong> Investigation and Court Proceedings<br />

Documents <strong>of</strong> investigation actions made as provided herein, fixing circumstances apprehended<br />

by <strong>the</strong> person in charge <strong>of</strong> <strong>the</strong> criminal case, and discovered during search, inspection,<br />

examination, seizure, detention, identification, disinterment <strong>of</strong> corpse, checking testimony at <strong>the</strong><br />

site, experiment, telephone and o<strong>the</strong>r conversations, and o<strong>the</strong>r proceedings on <strong>the</strong> criminal case<br />

as well as transcripts <strong>of</strong> <strong>the</strong> court proceedings, showing <strong>the</strong> progress <strong>of</strong> court actions and <strong>the</strong>ir<br />

results, shall be considered records for <strong>the</strong> criminal case.<br />

Article 91. Pro<strong>of</strong><br />

CHAPTER 10. COLLECTING, TESTING, EVALUATING EVIDENCE<br />

(1) Pro<strong>of</strong> consists <strong>of</strong> collection, testing evaluation on <strong>the</strong> evidence in order to establish facts <strong>of</strong><br />

significance for legal, well-grounded and just case resolution.<br />

(2) Collection <strong>of</strong> <strong>the</strong> evidence shall be performed during <strong>the</strong> investigation and court proceedings<br />

by way <strong>of</strong> questioning, confrontation, identification, seizure, search and inspection,<br />

experiments, audits, expertise, requesting documents and o<strong>the</strong>r investigational and court<br />

proceedings stipulated by <strong>the</strong> law.<br />

(3) Investigator, court, shall be entitled within <strong>the</strong>ir proceedings on <strong>the</strong> cases to summon any<br />

person for questioning or for <strong>the</strong> expert’s opinion as stipulated by this <strong>Code</strong>; to inspect,<br />

search and conduct o<strong>the</strong>r investigational proceedings; require from organizations,<br />

associations, <strong>of</strong>ficials, persons, and investigation agencies documents and things significant<br />

for <strong>the</strong> case; require audit and check from appropriate bodies and <strong>of</strong>ficials.<br />

(4) The defense attorney shall be entitled to introduce evidences and to collect information<br />

required for legal assistance, as well as to demanding information, references and o<strong>the</strong>r<br />

documents from different organizations and <strong>the</strong>ir associations, which, in <strong>the</strong>ir turn, shall be<br />

obliged to provide such documents or <strong>the</strong>ir copies; with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> client to inquire<br />

experts’ conclusions in order to clarify questions occurred while providing legal assistance<br />

when such questions require special skills; utilize services <strong>of</strong> private detectives or detective<br />

agencies in order to obtain information related to <strong>the</strong> case pursuant to <strong>the</strong> Law on Advocacy<br />

and Advocate Activity.<br />

(5) The suspect, accused, defendant, defense attorney, prosecutor, victim, civil plaintiff, civil<br />

defendant and <strong>the</strong>ir representatives, any citizen, organization and <strong>the</strong>ir associations shall be
