this <strong>Code</strong>, <strong>the</strong> prosecutor shall restitute legal proceedings on <strong>the</strong> case due to newly<br />
discovered evidence, conduct a necessary check-up, request a copy <strong>of</strong> <strong>the</strong> verdict and a court<br />
statement supporting that it has become res judicata.<br />
(4) If <strong>the</strong>re are o<strong>the</strong>r circumstances referred to in a received application or information <strong>the</strong>n those<br />
specified in item 4 <strong>of</strong> <strong>the</strong> second part <strong>of</strong> Article 384 <strong>of</strong> this <strong>Code</strong>, <strong>the</strong> prosecutor within<br />
his/her competence shall deduce an injunction to restitute legal proceedings due to newly<br />
discovered evidence, send <strong>the</strong> case to <strong>the</strong> investigator to review <strong>the</strong>se evidence. The<br />
investigation <strong>of</strong> a case due to newly discovered evidence shall be effectuated pursuant to <strong>the</strong><br />
requirements <strong>of</strong> this <strong>Code</strong>.<br />
Article 388. Actions <strong>of</strong> <strong>the</strong> Prosecutor upon Completion <strong>of</strong> a Check up or an Investigation<br />
(1) Upon completion <strong>of</strong> a check up or investigation due to newly discovered evidence, provided<br />
<strong>the</strong>re are grounds to restitute legal proceedings on a case, <strong>the</strong> prosecutor shall send <strong>the</strong> case<br />
with his/her statement attached to it to <strong>the</strong> corresponding Court.<br />
(2) If <strong>the</strong>re are not grounds for <strong>the</strong> restitution <strong>of</strong> legal proceedings on a case, <strong>the</strong> prosecutor shall<br />
discontinue legal proceedings on <strong>the</strong> case due to newly discovered evidence by his/her<br />
grounded injunction.<br />
(3) An injunction in respect <strong>of</strong> discontinuation <strong>of</strong> legal proceedings shall be communicated to<br />
interested parties with an appropriate clarification <strong>of</strong> <strong>the</strong>ir right to contest it in court.<br />
Article 389. Injunction by <strong>the</strong> Court Reviewing <strong>the</strong> Prosecutor’s Statement<br />
Having reviewed <strong>the</strong> prosecutor’s statement on restitution <strong>of</strong> legal proceedings on a case due to<br />
newly discovered evidence, <strong>the</strong> court shall deduce one <strong>of</strong> <strong>the</strong> following injunctions:<br />
(1) on nullification <strong>of</strong> <strong>the</strong> verdict, court ruling or injunction <strong>of</strong> a judge and transfer <strong>of</strong> <strong>the</strong> case for<br />
fur<strong>the</strong>r investigation and new trial;<br />
(2) on nullification <strong>of</strong> <strong>the</strong> verdict, court ruling or injunction and on discontinuance <strong>of</strong> <strong>the</strong> case<br />
when no fur<strong>the</strong>r investigation or trial is not needed to reach <strong>the</strong> final decision on <strong>the</strong> case;<br />
(3) on rejection <strong>of</strong> <strong>the</strong> prosecutor’s statement.<br />
Article 390. Legal Proceedings upon Nullification <strong>of</strong> Court Injunctions<br />
The investigation and trial <strong>of</strong> a case upon nullification <strong>of</strong> court injunction in its respect due to<br />
newly discovered evidence, as well as appellation <strong>of</strong> newly deduced court injunctions shall be<br />
effectuated pursuant to <strong>the</strong> general procedure.<br />
SECTION XIII. PARTICULARS OF LEGAL PROCEEDINGS ON CERTAIN<br />
CATEGORIES OF CASES<br />
CHAPTER 44. LEGAL PROCEEDINGS IN RESPECT OF OFFENSES COMMITTED<br />
BY JUVENILE OFFENDERS<br />
Article 391. <strong>Procedure</strong> for Legal Proceedings on Juvenile Cases
