4) follow <strong>the</strong> rules <strong>of</strong> behavior during investigative proceedings <strong>of</strong> <strong>the</strong> investigative actions<br />
and during <strong>the</strong> trial;<br />
(3) When <strong>the</strong> expert fails to appear without justifiable reasons, <strong>the</strong>re may be imposed a fine <strong>of</strong> up<br />
to five minimum monthly salaries as provided herein by Articles 120 and 121.<br />
(4) For refusal or evasion to perform his duties without justifiable reasons, <strong>the</strong> expert shall be<br />
liable in accordance with Article 331 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>. And for<br />
perjury he shall be liable in accordance with Article 330 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong><br />
<strong>Republic</strong>.<br />
(5) Expert has no right to:<br />
1) conduct negotiations with participants <strong>of</strong> <strong>the</strong> procedure regarding <strong>the</strong> issues, related to<br />
expert examination;<br />
2) collect research materials by himself;<br />
3) conduct researches that may cause complete or partial destruction <strong>of</strong> <strong>the</strong> presented<br />
objects, or <strong>the</strong>ir shape and main characteristics, if <strong>the</strong>re was no special permission from<br />
<strong>the</strong> investigator, <strong>the</strong> court.<br />
Article 64. Specialist<br />
Specialist is a person not personally interested in <strong>the</strong> criminal case, summoned by <strong>the</strong><br />
investigator, <strong>the</strong> court to assist in investigative or o<strong>the</strong>r proceedings actions with <strong>the</strong> use <strong>of</strong><br />
specific skills and knowledge in science, technology, art, pr<strong>of</strong>ession. Educational specialist<br />
participating in <strong>the</strong> interrogation <strong>of</strong> a juvenile victim, suspect, accused, defendant, witness is also<br />
considered a specialist. Specialist may be assigned from <strong>the</strong> list <strong>of</strong> persons suggested by <strong>the</strong><br />
participants <strong>of</strong> <strong>the</strong> criminal proceedings on <strong>the</strong> case.<br />
Article 65. Rights and Duties <strong>of</strong> a Specialist<br />
(1) Specialist has <strong>the</strong> right to:<br />
1) know <strong>the</strong> purpose <strong>of</strong> his summons;<br />
2) refuse to participate in <strong>the</strong> proceedings on <strong>the</strong> case if he does not possess necessary skills<br />
and knowledge;<br />
3) with <strong>the</strong> permission <strong>of</strong> <strong>the</strong> investigator, or <strong>the</strong> court, to ask questions <strong>of</strong> <strong>the</strong> participants <strong>of</strong><br />
<strong>the</strong> investigative proceeding;<br />
4) study <strong>the</strong> transcript <strong>of</strong> <strong>the</strong> proceeding <strong>of</strong> investigation in which he takes part, and make<br />
statements and comments subject to recording;<br />
5) lodge complaints against actions <strong>of</strong> <strong>the</strong> investigator, court;<br />
6) receive a reward for <strong>the</strong> work performed by him, reimbursement <strong>of</strong> his expenses incurred<br />
during <strong>the</strong> proceedings on <strong>the</strong> criminal case;<br />
(2) Specialist shall:<br />
1) appear when summoned;<br />
2) participate in investigative proceedings <strong>of</strong> <strong>the</strong> actions and in <strong>the</strong> court proceedings by<br />
using specific knowledge, skills and scientific-technical means;<br />
3) give explanations regarding actions performed by him;<br />
4) follow <strong>the</strong> rules <strong>of</strong> behavior during investigative proceedings and during <strong>the</strong> trial;<br />
5) not divulge <strong>the</strong> information about facts <strong>of</strong> <strong>the</strong> case and o<strong>the</strong>r information that became<br />
known to him in connection with his participation in <strong>the</strong> case;<br />
(3) For refusal or evasion <strong>of</strong> <strong>the</strong> specialist to fulfill his duties without justifiable reasons, <strong>the</strong>re<br />
may be imposed a fine <strong>of</strong> up to five minimum monthly salary as provided herein by Articles<br />
120 and 121.<br />
Article 66. Interpreter/Translator<br />
(1) Interpreter/translator is a person not personally interested in <strong>the</strong> criminal case, having a<br />
command <strong>of</strong> a foreign language, and also understanding deaf and mute signs knowledge <strong>of</strong><br />
which is necessary for <strong>the</strong> translation, summoned for participation in <strong>the</strong> investigative and<br />
court proceedings in cases when <strong>the</strong> suspect, accused, defendant, <strong>the</strong>ir defense attorneys or
