(5) Any search, except for <strong>the</strong> cases when a delay is impossible, shall not be enforced at night.<br />
(6) In necessary cases a search shall be enforced with a participation <strong>of</strong> a specialist and an<br />
interpreter.<br />
(7) Before search, seizure enforcement <strong>the</strong> investigator shall submit a resolution on <strong>the</strong>ir<br />
enforcement.<br />
(8) Starting a search <strong>the</strong> investigator shall make a suggestion to give out voluntary objects and<br />
documents that are subject for withdrawal.<br />
(9) In <strong>the</strong> course <strong>of</strong> a search closed premises and storage’s may be broken and entered when an<br />
owner does not want to open <strong>the</strong>m voluntarily. While doing this it shall be prohibited to<br />
break o<strong>the</strong>r than necessary for opening locks <strong>of</strong> doors and o<strong>the</strong>r objects.<br />
(10) In <strong>the</strong> course <strong>of</strong> seizure <strong>the</strong> investigator shall suggest to give out objects and documents that<br />
are subject for seizure and in case <strong>of</strong> a wave he shall enforce a compulsory seizure.<br />
(11) Any search and seizure enforced in dwelling houses against <strong>the</strong> will <strong>of</strong> living in <strong>the</strong>m<br />
persons shall be enforced according to <strong>the</strong> rules <strong>of</strong> items 9 <strong>of</strong> Article 177 <strong>of</strong> this <strong>Code</strong>.<br />
(12) Any search and seizure in dwelling houses, premises <strong>of</strong> companies, organizations and<br />
establishments shall be enforced in <strong>the</strong> presence <strong>of</strong> persons specified in items 11 and 12 <strong>of</strong><br />
Article 177 <strong>of</strong> <strong>the</strong> <strong>Code</strong>.<br />
(13) Any search and seizure in premises occupied by diplomatic representations as well as<br />
dwelling houses in which members <strong>of</strong> diplomatic representations and <strong>the</strong>ir families live shall<br />
be enforced with observation <strong>of</strong> <strong>the</strong> requirements established by item 13 <strong>of</strong> Article 177 <strong>of</strong><br />
this <strong>Code</strong>.<br />
(14) Any investigator shall undertake measures not to disclose <strong>the</strong> discovered in <strong>the</strong> course <strong>of</strong> a<br />
search or seizure circumstances <strong>of</strong> a private life <strong>of</strong> a person who stays in a dwelling house or<br />
o<strong>the</strong>r persons.<br />
(15) Any investigator shall be authorized to prohibit persons that are in a dwelling house or place<br />
where a search or seizure are enforced or persons who came to such dwelling house or place<br />
to leave it or communicate with each o<strong>the</strong>r or o<strong>the</strong>r persons before <strong>the</strong> completion <strong>of</strong> a search<br />
or seizure.<br />
(16) In <strong>the</strong> course <strong>of</strong> a search or seizure while withdrawing objects <strong>the</strong> investigator shall be<br />
strictly limited with objects and documents that are related to a case. Any objects or<br />
documents prohibited for circulation shall be withdrawn irrespective <strong>of</strong> <strong>the</strong>ir relationship to a<br />
case.<br />
(17) All withdrawn objects and documents shall be submitted to <strong>the</strong> persons who are present and<br />
if it is necessary shall be packed and sealed at <strong>the</strong> place <strong>of</strong> search or seizure enforcement and<br />
shall be certified with signatures <strong>of</strong> <strong>the</strong> persons who are present.<br />
Article 185. Personal search<br />
(1) Any personal search shall be enforced in accordance with <strong>the</strong> requirements <strong>of</strong> this Article <strong>of</strong><br />
this <strong>Code</strong> when <strong>the</strong>re are grounds stipulated by Article 184. Upon <strong>the</strong> investigator’s request it<br />
shall be enforced with an aim to discover and withdraw objects and documents that are on<br />
searched person’s body, in his clo<strong>the</strong>s or belonged to him things by an <strong>of</strong>ficer <strong>of</strong> an agency <strong>of</strong><br />
preliminary investigation or some o<strong>the</strong>r person.<br />
(2) Any personal search shall be enforced by a person <strong>of</strong> <strong>the</strong> same with a searched sex with a<br />
participation <strong>of</strong> identifying witnesses and, if necessary, <strong>of</strong> a specialist.
