4) arguments <strong>of</strong> a person filed a compliant (petition) as to <strong>the</strong> mistakes made in <strong>the</strong> verdict,<br />
resolution, formulation and <strong>the</strong> substance <strong>of</strong> his/ her request;<br />
5) list <strong>of</strong> materials attached to <strong>the</strong> complaint (petition);<br />
6) signature <strong>of</strong> a person who files <strong>the</strong> complaint (petition).<br />
Article 341. Subject <strong>of</strong> Appellate Review<br />
(4) Based on <strong>the</strong> appeals and petitions, <strong>the</strong> court <strong>of</strong> appellate jurisdiction verifies that <strong>the</strong> facts<br />
<strong>of</strong> <strong>the</strong> case were established and criminal law was applied properly, as well as whe<strong>the</strong>r <strong>the</strong><br />
norms <strong>of</strong> criminal procedure law were observed during trial.<br />
(5) In those cases where <strong>the</strong> case trial in respect <strong>of</strong> <strong>the</strong> convicted appealing against <strong>the</strong> verdict<br />
ceoncerns o<strong>the</strong>r convicted, <strong>the</strong> case shall be tried in <strong>the</strong>ir respect too.<br />
Article 342. Composition <strong>of</strong> Court while Appellate Review <strong>of</strong> Cases<br />
(1) The appellate review <strong>of</strong> cases shall be exercised by <strong>the</strong> appellate collegium composed<br />
<strong>of</strong> three pr<strong>of</strong>essional judges.<br />
(2) Oblast, Bishkek City Courts, Military Court <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall exercise <strong>the</strong><br />
case filed on petitions later 30 days after its filing. No later three days before <strong>the</strong> case<br />
review an announcement on revilwing time is provided.<br />
Article 343. Setting <strong>the</strong> Hearing <strong>of</strong> Court <strong>of</strong> Appellate Jurisdiction<br />
(1) After receipt <strong>of</strong> a case with appellate complaint or petition, <strong>the</strong> chief justice <strong>of</strong> <strong>the</strong> court, or<br />
his/her deputy shall appoint <strong>the</strong> panel <strong>of</strong> appellate collegium, and determine <strong>the</strong> presiding<br />
judge on this case.<br />
(2) In resolving issues related to setting <strong>the</strong> case to consideration in <strong>the</strong> appellate procedure, <strong>the</strong><br />
presiding judge is governed by general rules provided by this <strong>Code</strong>.<br />
(3) The presiding judge shall render a resolution on <strong>the</strong> setting a hearing <strong>of</strong> <strong>the</strong> court, where <strong>the</strong><br />
reporting judge on <strong>the</strong> case and summoned persons shall be indicated.<br />
Article 344. Order <strong>of</strong> Appellate Proceedings<br />
(1) Appellate proceedings shall be conducted in accordance with <strong>the</strong> rules <strong>of</strong> procedure <strong>of</strong> <strong>the</strong><br />
court <strong>of</strong> original jurisdiction, and in compliance with <strong>the</strong> provisions stated in this Chapter.<br />
(2) The parties shall be informed on <strong>the</strong> time when <strong>the</strong> case will be tried. Failure by persons who<br />
did not file a complaint to <strong>the</strong> verdict <strong>of</strong> <strong>the</strong> court <strong>of</strong> original instance shall not impede <strong>the</strong><br />
examination <strong>of</strong> <strong>the</strong> case, and rendering <strong>the</strong> decision.<br />
(3) Participation <strong>of</strong> <strong>the</strong> following is mandatory in <strong>the</strong> court hearing:<br />
1) prosecutor;<br />
2) personal prosecutor who filed <strong>the</strong> complaint;<br />
3) defendant who filed <strong>the</strong> complaint, or whose interests are protected by <strong>the</strong> complaint filed<br />
by his defense counsel or legal representative, or in whose respect <strong>the</strong> prosecutor brought<br />
a report, or a complaint filed by <strong>the</strong> victim.<br />
(4) The schedule <strong>of</strong> court hearing and measures taken in respect to <strong>of</strong>fenders are determined by<br />
Article 269, 271 here<strong>of</strong>.
