(5) When a case is dismissed on <strong>the</strong> grounds stipulated by Articles 28 and 29 <strong>of</strong> this <strong>Code</strong> a court<br />
shall leave <strong>the</strong> claim without consideration.<br />
(6) If because <strong>of</strong> <strong>the</strong> grounds stipulated by paragraph 9 <strong>of</strong> item 1 <strong>of</strong> Article 28 <strong>of</strong> this <strong>Code</strong> a<br />
criminal case is dismissed at a pretrial stage <strong>of</strong> proceedings, a person or a legal entity or <strong>the</strong>ir<br />
representatives shall be authorized to file a claim according to <strong>the</strong> civil procedure.<br />
Article 142. Obligation to Provide for a Civil Claim and Property Confiscation Stipulated<br />
by <strong>the</strong> Law<br />
(6) If <strong>the</strong>re are sufficient facts proving property damage caused by <strong>the</strong> crime, <strong>the</strong> agency <strong>of</strong><br />
preliminary investigation, investigator, prosecutor, and <strong>the</strong> court are obliged to take<br />
measures to provide for <strong>the</strong> filed or potential civil claim.<br />
(7) For <strong>the</strong> cases on crimes for which <strong>the</strong> criminal law stipulates confiscation <strong>of</strong> property, <strong>the</strong><br />
investigator, or <strong>the</strong> agency <strong>of</strong> preliminary investigation shall take necessary measures to<br />
provide for execution <strong>of</strong> <strong>the</strong> sentence regarding possible confiscation, by rendering an<br />
appropriate resolution on that.<br />
(8) Providing for <strong>the</strong> civil claim and possible confiscation <strong>of</strong> property is executed through<br />
imposing arrest on deposits, values and o<strong>the</strong>r property, as stated in <strong>the</strong> inventory, <strong>of</strong> <strong>the</strong><br />
accused or <strong>the</strong> persons, who bear property responsibility, as stipulated by <strong>the</strong> law, for <strong>the</strong><br />
actions <strong>of</strong> <strong>the</strong> accused, and also through withdrawal <strong>of</strong> <strong>the</strong> arrested property.<br />
(9) If a civil claim is satisfied, before <strong>the</strong> verdict takes effect, <strong>the</strong> court shall be authorized to<br />
render a resolution on enforcement measures to provide for execution <strong>of</strong> <strong>the</strong> claim if such<br />
measures have not been taken yet.<br />
Article 143. Execution <strong>of</strong> a Sentence and Court Ruling Regarding a Civil Claim<br />
When a civil claim was satisfied by court a sentence as well as ruling on enforcement <strong>of</strong><br />
compulsory medical treatment in respect <strong>of</strong> <strong>the</strong> civil claim shall be executed according to <strong>the</strong><br />
procedure stipulated by Judgement Enforcement Law.<br />
SECTION 17. PROCEDURAL TIME LIMITS. PROCEDURAL COSTS<br />
Article 144. Calculation <strong>of</strong> time limits<br />
(1) Procedural time limits shall be calculated by hours, days, months, and years.<br />
(2) Calculation <strong>of</strong> a time limit shall be made with <strong>the</strong> observation <strong>of</strong> <strong>the</strong> following rules:<br />
1) <strong>the</strong> day in calculation <strong>of</strong> a time limit shall be considered consisting <strong>of</strong> 24 hours. When a<br />
time limit is calculated in days, it shall expire at 12 p.m. <strong>of</strong> <strong>the</strong> last day;<br />
2) <strong>the</strong> day, when a time limit starts, shall not be taken into account in calculation <strong>of</strong> time<br />
limits;<br />
3) a month and a year shall be calculated according to <strong>the</strong> calendar; when a time limit is<br />
calculated in months and years it shall expire on <strong>the</strong> corresponding date <strong>of</strong> <strong>the</strong> last month,<br />
year. If <strong>the</strong> end <strong>of</strong> a time limit calculated in months shall be in a month that lacks <strong>the</strong><br />
corresponding date, <strong>the</strong> time limit shall end on <strong>the</strong> last day <strong>of</strong> <strong>the</strong> month;
