(3) The parties may confirm <strong>the</strong> grounds for or objections against filing such a petition by<br />

ano<strong>the</strong>r party, by filing with <strong>the</strong> court new materials, or bring a motion to summon to court<br />

<strong>the</strong> witnesses and experts indicated by this party, if such case is to be tried in compliance<br />

with <strong>the</strong> appellate procedure.<br />

Article 338. Consequences <strong>of</strong> Filing Petition<br />

(1) Filing <strong>of</strong> petition suspends execution <strong>of</strong> <strong>the</strong> verdict.<br />

(2) Upon expiration <strong>of</strong> a deadline established for appeal <strong>of</strong> <strong>the</strong> verdict, <strong>the</strong> court which rendered<br />

<strong>the</strong> verdict shall submit <strong>the</strong> case with <strong>the</strong> received petitions and objections to <strong>the</strong> court <strong>of</strong><br />

appellate or cassational jurisdiction, with <strong>the</strong> notice <strong>of</strong> <strong>the</strong> parties.<br />

(3) A person who filed <strong>the</strong> petition may revoke <strong>the</strong>m prior to <strong>the</strong> commencement <strong>of</strong> <strong>the</strong> hearing<br />

<strong>of</strong> <strong>the</strong> court <strong>of</strong> appellate or cassational jurisdiction.<br />

(4) A person who appealed <strong>the</strong> verdict may amend his/ her petition, or add new arguments in it.<br />

Article 339. Appeal <strong>of</strong> Decision (Resolution) Rendered by Court <strong>of</strong> Primary Jurisdiction<br />

(1) Persons indicated in point 2 <strong>of</strong> Article 332 here<strong>of</strong> may file a personal complaint or personal<br />

petition to <strong>the</strong> decision (resolution) rendered by <strong>the</strong> court <strong>of</strong> original jurisdiction, with <strong>the</strong><br />

exceptions established in point two <strong>of</strong> this Article.<br />

(2) Under <strong>the</strong> rules <strong>of</strong> this Chapter, decisions (resolutions) rendered in <strong>the</strong> trial regarding <strong>the</strong><br />

procedure <strong>of</strong> examination <strong>of</strong> evidence, motions filed by <strong>the</strong> participants <strong>of</strong> <strong>the</strong> trial, choosing,<br />

alteration or dismissal <strong>of</strong> <strong>the</strong> sanction, and observation <strong>of</strong> <strong>the</strong> order in <strong>the</strong> court room, except<br />

decisions (rulings) on imposition <strong>of</strong> monetary sanction (fine), may not be appealed.<br />

(3) Personal complaint and petition to <strong>the</strong> decision (resolution) rendered by <strong>the</strong> court <strong>of</strong> original<br />

jurisdiction shall be filed to <strong>the</strong> superior court within ten days as <strong>of</strong> <strong>the</strong> date when <strong>the</strong><br />

decision subject to appeal was rendered, and shall be reviewed in compliance with <strong>the</strong> rules<br />

provided by Article 345 here<strong>of</strong>. Based on <strong>the</strong> results <strong>of</strong> consideration, <strong>the</strong> decision shall be<br />

rendered on dismissal <strong>of</strong> <strong>the</strong> complaint or petition, or repeal or amendment <strong>of</strong> <strong>the</strong> decision<br />

being appealed.<br />

(4) Persons who are not parties to <strong>the</strong> case may also appeal <strong>the</strong> decision or resolution <strong>of</strong> <strong>the</strong><br />

court, if such decision or resolution affects <strong>the</strong>ir interests.<br />

CHAPTER 39. APPELLATE REVIEW OF CASES BASED ON THE APPEALS,<br />

PETITION TO THE DICISIONS RENDERED BY A COURT WHICH DID NOT ENTER<br />

INTO LEGAL FORCE.<br />

Article 340. Appellate Complaint and Petition on Verdict Resolution, Formulation<br />

(1) The appellate complaint (petition) must contain <strong>the</strong> following:<br />

1) <strong>the</strong> name <strong>of</strong> <strong>the</strong> court where <strong>the</strong> complaint is submitted;<br />

2) <strong>the</strong> information on a person who files <strong>the</strong> complaint (petition) with indication <strong>of</strong> his/ her<br />

procedural status and <strong>the</strong> place <strong>of</strong> residence or location;<br />

3) verdict or o<strong>the</strong>r decision which is appealed, and <strong>the</strong> name <strong>of</strong> <strong>the</strong> court which renders such<br />

decision;
