investigatory actions. In necessary cases in <strong>the</strong> course <strong>of</strong> <strong>the</strong>ir enforcement <strong>the</strong> investigator,<br />
court may make measurements, photographing, video and audio surveys, make plans and<br />
charts.<br />
(2) If it is necessary for <strong>the</strong> restoration <strong>of</strong> <strong>the</strong> situation and circumstances <strong>of</strong> an event <strong>the</strong> suspect,<br />
accused, victim, witnesses and <strong>the</strong> relevant specialists may be summoned.<br />
(3) Statements (testimony) <strong>of</strong> <strong>the</strong> suspected, accused, victim, or witness may be checked and<br />
defined more precisely at <strong>the</strong> site, related to <strong>the</strong> investigated event, in order to establish new<br />
actual facts, rout and places, where <strong>the</strong> tested actions took place, and to check <strong>the</strong><br />
au<strong>the</strong>nticity <strong>of</strong> statements by matching <strong>the</strong>m to <strong>the</strong> event circumstances. During it:<br />
1) checking statements at site may consist <strong>of</strong> <strong>the</strong> following actions by <strong>the</strong> person, who is<br />
testifying: reproduces at <strong>the</strong> site <strong>the</strong> conditions and circumstances <strong>of</strong> <strong>the</strong> investigated<br />
event; finds and shows objects, documents, traces, important for <strong>the</strong> case; demonstrates<br />
certain actions; shows <strong>the</strong> role <strong>of</strong> certain objects in <strong>the</strong> investigated event; draws attention<br />
to <strong>the</strong> changes in <strong>the</strong> site conditions; concretizes and makes more precise his prior<br />
statements. Any interference in <strong>the</strong>se actions and leading questions shall be prohibited.<br />
2) in necessary cases checking statements at site may be carried out with presence <strong>of</strong><br />
specialist;<br />
3) checking statements at site <strong>of</strong> several persons at once shall be prohibited;<br />
4) checking statements shall start from <strong>the</strong> <strong>of</strong>fer to <strong>the</strong> person to show <strong>the</strong> route and <strong>the</strong><br />
place, where his statements will be checked. After free narration and demonstration <strong>of</strong><br />
actions <strong>the</strong> person, whose statements are being checked may be asked questions. Such<br />
person as well as o<strong>the</strong>r participants <strong>of</strong> <strong>the</strong> proceedings shall b authorized to require<br />
additional interrogation in relation to <strong>the</strong> enforced investigational experimentation.<br />
(4) The transcript <strong>of</strong> restoration <strong>of</strong> <strong>the</strong> situation and circumstances, and checking statements at<br />
site, proceedings shall be compiled considering <strong>the</strong> requirements <strong>of</strong> Articles 170 and 171 <strong>of</strong><br />
this <strong>Code</strong>. The transcript <strong>of</strong> proceeding shall indicate conditions, course and results <strong>of</strong><br />
checking statements at site.<br />
SECTION 23. SEARCH, SEIZURE, IMPOSING OF AN ARREST ON MAIL SENDING,<br />
CONTROL AND RECORDING OF CALLS<br />
Article 184. Grounds and procedure for search and seizure enforcement<br />
(1) If <strong>the</strong>re is enough information to believe that in some premises or place or in someone’<br />
possession <strong>the</strong>re may be an instrument <strong>of</strong> a crime, objects, documents, valuables that may be<br />
important for a case that shall be a basis for a search enforcement. The search may be also<br />
enforced to discover searched persons and corpses.<br />
(2) Seizure shall be enforced when it is necessary to withdraw some objects and documents that<br />
are important for a case and when it is definitely known where <strong>the</strong>y are situated and who<br />
owns <strong>the</strong>m.<br />
(3) Any search and seizure shall be enforced with participation <strong>of</strong> identifying witnesses, upon a<br />
motivated investigator’s resolution with a prosecutor’s warrant.<br />
(4) In some exception cases, when <strong>the</strong>re is a real threat that <strong>the</strong> searched object that has to be<br />
withdrawn may, because <strong>of</strong> a delay in its discovery be lost, damaged or utilized with criminal<br />
aims, or a searched person may escape, a search may be enforced by investigator’s resolution<br />
without a prosecutor’ s warrant but fur<strong>the</strong>r on, within a day, he shall be notified on that.
