(3) Bodies executing a verdict shall immediately notify <strong>the</strong> court that has issued <strong>the</strong> about its<br />

execution. The administration <strong>of</strong> <strong>the</strong> institution executing <strong>the</strong> verdict shall inform <strong>the</strong> court<br />

that has deduced <strong>the</strong> verdict about <strong>the</strong> location where <strong>the</strong> convicted serves his/her sentence.<br />

Article 361. Notification <strong>of</strong> Relatives <strong>of</strong> <strong>the</strong> Convicted and Civil Plaintiff <strong>of</strong> <strong>the</strong> Execution <strong>of</strong><br />

<strong>the</strong> Verdict<br />

(1) After <strong>the</strong> verdict becomes res judicata by virtue <strong>of</strong> which <strong>the</strong> convicted kept in custody is<br />

sentenced to arrest or imprisonment, <strong>the</strong> administration <strong>of</strong> <strong>the</strong> detention facility shall be<br />

bound to inform <strong>the</strong> convict’s family about <strong>the</strong> location where he/she is sent to serve <strong>the</strong><br />

sentence.<br />

(2) The civil plaintiff shall be informed upon <strong>the</strong> execution <strong>of</strong> <strong>the</strong> sentence in case <strong>the</strong> civil suit<br />

is satisfied.<br />

CHAPTER 41. PROCEEDINGS ON THE EXAMINATION AND INJUNCTION OF<br />

ISSUES RELATED TO THE EXECUTION OF VERDICTS<br />

Article 362. Deferment <strong>of</strong> <strong>the</strong> Execution <strong>of</strong> a Verdict<br />

(1) The execution <strong>of</strong> a verdict sentencing a convict to communal works, custody or<br />

imprisonment may be deferred provided <strong>the</strong>re is one <strong>of</strong> <strong>the</strong> following grounds present:<br />

1) <strong>the</strong> convict’s illness preventing him/her from serving <strong>the</strong> sentence—till his/her recovery;<br />

2) <strong>the</strong> convict’s pregnancy or minor children—till <strong>the</strong> youngest reaches <strong>the</strong> age <strong>of</strong> three<br />

years, except those convicted for particularly aggravated crimes;<br />

3) when immediate serving <strong>of</strong> <strong>the</strong> sentence may entail aggravated consequences for <strong>the</strong><br />

convict or his/her family due to <strong>the</strong> fire or any o<strong>the</strong>r natural calamities, serious illness, <strong>the</strong><br />

death <strong>of</strong> <strong>the</strong> only family member capable to work and o<strong>the</strong>r extraordinary<br />

circumstances—for <strong>the</strong> time period ordered by <strong>the</strong> court, however, no longer than for six<br />

months.<br />

(2) The payment <strong>of</strong> <strong>the</strong> fine may be deferred or extended by installments up to three months, if<br />

<strong>the</strong> immediate payment is impossible for <strong>the</strong> convicted.<br />

(3) The issue <strong>of</strong> deferment <strong>of</strong> <strong>the</strong> execution <strong>of</strong> a sentence shall be resolved by <strong>the</strong> court upon a<br />

petition lodged by <strong>the</strong> convict, his/her legal representative, close relatives, defense attorney<br />

or upon <strong>the</strong> prosecutor’s petition.<br />

Article 363. Release From Serving a Sentence Due to Serious Illness<br />

(1) In cases where <strong>the</strong> convict begins to suffer from a mental disorder or any o<strong>the</strong>r serious<br />

illness when serving <strong>the</strong> sentence which prevents <strong>the</strong> convict from serving out <strong>the</strong> sentence,<br />

upon <strong>the</strong> petition <strong>of</strong> <strong>the</strong> chief <strong>of</strong>ficer <strong>of</strong> <strong>the</strong> administration <strong>of</strong> <strong>the</strong> detention institution<br />

executing <strong>the</strong> verdict and based on <strong>the</strong> expert statement <strong>of</strong> a medical commission, <strong>the</strong> court<br />

shall have <strong>the</strong> right to discharge <strong>the</strong> convict prematurely release him/her from serving <strong>the</strong><br />

sentence any fur<strong>the</strong>r.<br />

(2) When releasing <strong>the</strong> convict who has begun to suffer from a mental disorder from serving out<br />

<strong>the</strong> sentence any fur<strong>the</strong>r, <strong>the</strong> court shall have <strong>the</strong> right to simultaneously apply to him/her
