(2) The resolution (ruling) <strong>of</strong> <strong>the</strong> Panel <strong>of</strong> Judges <strong>of</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall be<br />

signed by all judges that participated in case trial. The resolution (ruling) <strong>of</strong> <strong>the</strong> Presidium <strong>of</strong><br />

<strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall be signed by <strong>the</strong> presiding judge and reporting<br />

judge. In exceptional cases on particularly complicated case <strong>the</strong> compilation <strong>of</strong> <strong>the</strong> valid<br />

decision may be postponed on <strong>the</strong> term <strong>of</strong> no more than ten days, but <strong>the</strong> resolution part shall<br />

be compiled and signed by all judges, who participated in <strong>the</strong> trial, in <strong>the</strong> conference room.<br />

(3) The resolution (ruling) shall be announced by <strong>the</strong> presiding judge or reporting judge. All<br />

persons that are present in <strong>the</strong> court room shall rise when hearing <strong>the</strong> resolution (ruling).<br />

Article 380. Special Opinion <strong>of</strong> Judge <strong>of</strong> <strong>the</strong> court reviewing res judicata verdicts<br />

Judge <strong>of</strong> <strong>the</strong> court reviewing res judicata verdicts who stayed in special opinion during case trial<br />

shall state it in writing. Special opinion <strong>of</strong> a judge shall not be announced but shall be enclosed<br />

to <strong>the</strong> case materials.<br />

Article 381. Personal ruling <strong>of</strong> <strong>the</strong> court reviewing res judicata verdicts<br />

(1) Simultaneously with rendering a resolution <strong>the</strong> court reviewing res judicata verdicts in<br />

necessary cases shall render a personal ruling to draw attention <strong>of</strong> heads <strong>of</strong> Ministries, State<br />

Committees, Administrative Departments and Enterprises, Institutes and Organizations<br />

irrespectively <strong>of</strong> <strong>the</strong> property forms and o<strong>the</strong>r <strong>of</strong>ficials to <strong>the</strong> established facts <strong>of</strong> law<br />

violation in <strong>the</strong> case, reason and conditions promoting to violation <strong>of</strong> <strong>the</strong> law.<br />

(2) Mentioned persons shall within one month inform <strong>the</strong> court reviewing res judicata verdicts<br />

about measures undertaken by <strong>the</strong>m in respect <strong>of</strong> <strong>the</strong> personal ruling.<br />

Article 382. Execution <strong>of</strong> resolutions and rulings rendered by <strong>the</strong> court reviewing res<br />

judicata verdicts<br />

(1) The resolutions and rulings rendered by <strong>the</strong> court reviewing res judicata verdicts shall come<br />

into legal force immediately after <strong>the</strong>y have been taken and shall be executed in order<br />

provided herein and <strong>Criminal</strong>-Executive <strong>Code</strong> <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong><br />

(2) The resolutions and rulings <strong>of</strong> <strong>the</strong> Presidium and Panel <strong>of</strong> Judges on criminal cases and cases<br />

on administrative <strong>of</strong>fences <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall be definitive and<br />

shall not be subject to complaint.<br />

Article 383. Decisions taken by <strong>the</strong> court in reviewing procedure<br />

(1) The court reviewing res judicata verdicts (Presidium <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong><br />

<strong>Republic</strong> and <strong>the</strong> Panel <strong>of</strong> Judges on criminal and cases on administrative <strong>of</strong>fences <strong>of</strong><br />

<strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>) having tried <strong>the</strong> case in reviewing procedure<br />

shall take one <strong>of</strong> <strong>the</strong> following decisions:
