Article 176 Participation <strong>of</strong> identifying witnesses<br />

In <strong>the</strong> cases provided by this code, investigatory proceedings shall be carried out with<br />

participation <strong>of</strong> not less than two identifying witnesses, who shall be summoned to certify <strong>the</strong><br />

fact <strong>of</strong> <strong>the</strong> carried out investigatory action, its progress and result.<br />

Prior to <strong>the</strong> investigatory proceeding <strong>the</strong> investigator shall explain <strong>the</strong> identifying witnesses <strong>the</strong><br />

purpose <strong>of</strong> <strong>the</strong> proceeding, <strong>the</strong>ir rights and responsibilities, stipulated by Articles 68, 69 <strong>of</strong> this<br />

<strong>Code</strong>.<br />

SECTION 22. INSPECTION, EXPERT EXAMINATION, INVESTIGATORY<br />

EXPERIMENTATION<br />

Article 177. Grounds and <strong>Procedure</strong> for Inspection<br />

(1) Inspection shall be carried out with participation <strong>of</strong> identifying witnesses. In exceptional<br />

cases (in out-<strong>of</strong>-<strong>the</strong>-way place, when <strong>the</strong>re are no good facilities, as well as when <strong>the</strong><br />

inspection is connected with a threat to human life and health), <strong>the</strong> inspection may be carried<br />

out without participation <strong>of</strong> identifying witnesses.<br />

(2) Any inspection <strong>of</strong> <strong>the</strong> site <strong>of</strong> an event, territory, dwelling, objects, documents, and o<strong>the</strong>r<br />

material objects, shall be enforced in order to discover traces <strong>of</strong> <strong>the</strong> crime and o<strong>the</strong>r facts<br />

that are important for <strong>the</strong> case.<br />

(3) In <strong>the</strong> course <strong>of</strong> inspection, <strong>the</strong> investigator shall be authorized to summon <strong>the</strong> accused,<br />

suspect, victim, witness as well as a specialist for participation.<br />

(4) In necessary cases in <strong>the</strong> course <strong>of</strong> inspection, some measurements, video and audio taping,<br />

plans, charts making, moulding and printing <strong>of</strong> traces may be made and, if possible, prints<br />

toge<strong>the</strong>r with objects or <strong>the</strong>ir parts may be withdrawn, if received with and by <strong>the</strong> permitted<br />

by <strong>the</strong> law technical devices and methods.<br />

(5) Inspection <strong>of</strong> <strong>the</strong> discovered prints and o<strong>the</strong>r material evidence shall be made at places <strong>of</strong><br />

<strong>the</strong>ir discovery. If such inspection requires a lot <strong>of</strong> time and it is very difficult to make<br />

inspection <strong>of</strong> <strong>the</strong> place <strong>of</strong> <strong>the</strong>ir discovery, <strong>the</strong> objects shall be withdrawn, packed, sealed and<br />

without damaging transferred to ano<strong>the</strong>r more comfortable for such inspection place.<br />

(6) All discovered and withdrawn in <strong>the</strong> course <strong>of</strong> inspection shall be shown to participants <strong>of</strong><br />

<strong>the</strong> examination.<br />

(7) Only objects that are related to <strong>the</strong> case shall be subject for withdrawal. The withdrawn<br />

objects shall be packed and sealed.<br />

(8) Persons participating in <strong>the</strong> inspections shall be authorized to draw <strong>the</strong> investigator’s<br />

attention to everything <strong>the</strong>y believe may promote <strong>the</strong> discovery <strong>of</strong> <strong>the</strong> circumstances <strong>of</strong> <strong>the</strong><br />

case.<br />

(9) Inspection <strong>of</strong> a dwelling house shall be enforced only with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> residents. If <strong>the</strong><br />

residents are against <strong>the</strong> inspection, <strong>the</strong> investigator may enforce it on <strong>the</strong> basis <strong>of</strong> a<br />

motivated resolution with <strong>the</strong> prosecutor’s consent.<br />

(10) If a dwelling house is <strong>the</strong> site <strong>of</strong> an event and its inspection shall be enforced without a<br />

delay, <strong>the</strong> inspections shall be enforced on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> investigator’s resolution.
